My daughter is still at school but became a mother at the age of sixteen,(stupid girl) and will be in reciept of benefits for my grandaughter, should i still be paying maintenence for her, her mother has thrown her out of the family home the and she is now living with her grandparents, should my ex still be recieving maintenence monies from myself.

Firstly, if she is still in full-time education (despite being a parent) she may not be entitled to claim benefits [your daughter] in her own rights. If she is still in FTE and not claiming benefits she is still a qualifying child for maintenance purposes. You can call the CSA and ask them to check if she is in receipt of any benefits (they have access to the benefit systems).

Secondly, if your daughter is no longer living with your ex you should tell the CSA AND Child Benefit. If your ex does not confirm this to the CSA then the CSA will have to rely on Child Benefit making a decision.

The Grandparents will be entitled to make a claim against you both though if this is the case.
