If the claim is on the old system then yes they can.
If it is under the new system which depends on the age of the child and claim etc then they cannot take your wages into consideration.
They will look at his earning overs a set period of time and if they class as he is living a 'lavish' lifestyle beyond his means.
Best thing to do is put everything down as he earns now etc and as soon as things change then constantly update them and then they cant hit you at a later date for underpayment
Better still, don't involve them. Make your own arrangements, along with the contact arrangements and just use the CSA figures as a guideline. Unfortunately, but true, if your husband pays money to the CSA, it is unlikely that his child will ever receive the benefit. Either the CSA will take and keep the money or his ex will spend it on clothes, fags and booze. Sorry to be so cynical, but those are the real truths based on the personal experience of both myself and many, many others.
I take a bit of offence to that my ex pays NOTHING for my daughter and when he did i dit not spend it on fags and booze it went on keeping a roof over my daughters head. not everyone is the same
