my boyfriends ex wont inform csa details to stop payments

    my boyfriend has been paying csa payments since splitting up with his wife over 10years ago,the money goes straight to her from his employers,however,the girls are now 16 and 18, the 18 year old is now working and the 16 year old has dropped out of school (and is now moved in with her dad,my boyfriend)however the csa payments are still going out of my boyfriends paychecks despite phoning the csa to inform them of these details,the ex wife says she has phoned them but obviously hasnt.where does he stand?what should he do?he is still wanting to provide for his girls (thats not the issue)but surely money shouldnt be going out from his paycheck for a child who lives with him?and not for the 18 year old whos working,the children arent getting money from them as it goes on funding her lifestyle. please help!

    I assume the payments are being taken by a DEO. Write again to the CSA (recorded delivery), enclosing copies of the previous letters (with a copy to the employer), stating that they have fourteen days to cancel the DEO and return the over-payments already taken.

    If no response, then make an application to your local Magistrates Court (Family one) and ask for the DEO to be set aside. The minute the CSA get a copy of your application to the Court, they should react and cancel the DEO without the necessity of a hearing.

    Make an appointment with your MP and take a copy of the letters to him. He will then write to them as well and hopefully his clout will help as well. Good luck. These people are a complete nightmare.

    Phone the CSA and ask them to check the child benefit of the two children. If a child is working or no longer in the household then child benefit shouldn't be in payment. If child benefit is still in payment then you need to see about getting that sorted with the benefit agency as that would be fraud.
