Moving to the USA with my wife with my HM Forces job.

    Hi, am new to this so please forgive me. A brief background:

    I'm a serving member of the Royal Navy and as such am on HM Payroll, I'm posted out to the USA in April of this year for a 2.5 year tour. My wife and step-daughter are accompanying me on this tour, my step-daughters biological father currently pays maintenance through the CSA on a monthly basis while we live in UK.

    My question is this, is my wifes ex-partner legally bound to pay maintenance to his daughters mother while we are living in the USA. My wife won't be working while I work in the USA, is it really expected that I fully support (not that I have a problem with this) my step-daughter financially while I work for HM Government in the USA and the childs father pays nothing? (I of course being on an HM payroll have to pay CSA maintennce to my 2 children from a previous marriage)

    Any advice would be appreciated.

    I DONT KNOW THE ANSWEAR TO YOUR QUESTION BUT HE MAY WELL PAY ANYWAY.OBVIOUSLY I DONT KNOW ANYTHING ABOUT YOUR SITUATION BUT IVE GOT TO SAY I FEEL PRETTY SORRY FOR THE BIOLOGICAL FATHER.

  3. Whilst each case is different, it will depend on whether your partner (PWC) continues to be habitually resident in the UK. If not, the agency will cease to have jurisdiction.

    On a further note, if the child's father also has parental responsibility, their consent should be sort prior to the child leaving the country.

    The father of the child has indeed given consent to his daughter moving abroad with no hesitance whatsoever.

    Afairercsaforall, I thought as much, its ironic that me being in the HM Forces I'm still forced to pay CSA maintenance for my children (whom I've not seen for 4 years, not through choice I hasten to add)whils't working in the USA, yet my wifes ex doesn't have to pay any maintenance for his daugher (which he has consented to) at all while she accompanies myself in the USA. The mind boggles!!
