mistaken overpayment

    Just had a distressing call from the CSA. My daughter turned 18 in May 2008. Now in Feb 2010 they called to say an oversight has been made. No-one bothered to get in touch to tell me or my ex that he can stop paying maintainence for my daughter once she turned 18, like they do with child benefit. Now it seems I have to pay my ex back nearly 6k and it's not my (or his) fault.

    I fear for myself and my other child as he is the violent sort and will set his dogs on me as I do not have that kind of money. I have had to take an injunction out against him in the past.

    I would be ever so grateful for some advice.

    This is just another cock up by the CSA. Ask them for a breakdown in writing. If necessary go and get some advice from a solicitor specialising in CSA claims. There are some organisations that will try and fight CSA claims for overpayment. My story is on here as I am a Mum paying maintenance but so far I have had two comments which are not very nice from men which have really upset me so don't be surprised if you get comments too.     totally stressed im sorry my comment has upset you but can you not see you have opened your own can of worms.... its not the fact that the comment is from a man it is the fact you have made your own bed and you have to lie in it. Had you known your daughter was going to move out and this would be the outcome i feel you would have chosen differntly to start with. Its not me being harsh however you have met your just deserves.

    CSA or not they are deemed to be at fault I although a small amount got a payment from the CSA due to their inept ways. Contact the ICA (independant case examiner) easy enough through CAB or your MP. If they are shown to cause financial problems you can arrange for them to repay the money as most goes to the treasury anyway and you agree a repayment to suit you even if only 50p a week!
