Living abroad and coming back for a week to see family

    OK so here goes,

    Lets get the crap out of the way first.
    I did pay my ex all the time and was only late once.
    I did pay the CSA even though the amount was stupid but I had many a run in with them.
    I have saved into two funds for my kids after leaving the UK.

    I have lived outside of the UK now for quite some years now. After about four years without seeing my children, after spending thousands of pounds trying to see them and paying way too much through the CSA I was offered the opportunity to move abroad. After taking legal advice and funny enough advice from someone at the CSA (who told me the best bet was to go) I notified the CSA that I was leaving the country and the jurisdiction of the UK and would no longer be liable. I continued to pay my arrears and then stopped once they were paid off. I have continued a fund for each child in the country of my residence for them I would like to add.
    I have no idea where the kids are and I have moral issues with not paying for them NOW and if my ex would stop being such a tw*t about it, I would happily pay on a monthly basis through a bank. The caveat though, would be that I resume my relationship with my kids which I think is only fair…

    So here’s the question, If I come back to see my family for a week, would I be stopped at the airport and arrested. Would I have my passport taken from me? I ask as I’m a little freaked out by what I have read in the UK press recently….I am UK citizen living permanently outside of the commonwealth and the EU..

    You can only be arrested if the courts have issued a warrent. The legislation requires you to be notified of any committal hearing. If you have not had any notifications in the past then you will be fine.

    CSA jurisdiction only applies if the NRP is habitualy resident in the UK.
    You would still be liable if you are abroad and paid by a UK based Company.
    If you are not liable,paid up the arrears, you are not committing any offence,so should not have any worries.
