    I have been living abroad for the past 11 years and im ashamed to admit i have payed the csa nothing.I was paying in 1999 but lost my driving licence and so my job.I left the uk and have travelled about doing odd jobs and sometimes seasonal low payed work in various countries. Ive now returned to britain and am now being contacted by the csa for maintenance on my youngest daughter.Can i be held liable for arrears for the time ive been abroad?

    Hello my understanding of this situation relates to the jurisdiction of the CSA and as such if you were working overseas in countries that CSA have no recognition then you need not respond to any questions relating to income also CSA have to prove your income therefore they can only work on what you chose to disclose. Be aware that the CSA will make many claims citing various regulations and Acts but be aware that you should ask for specific parts and/or sections of these regs/acts as the true interpretation is not what they may claim.

    Social Security and Child Support (Decisions and Appeals Regulations 1999 Schedule 3D (3) is the legislation you need. It gives the effective date for child support purposes i.e the date you left the UK.

    You must be deemed to be none habitually resident. The Rules about HR can be found under Section 44 of the Child Support Act 1991.

    The issue you have raised is complex and I would recommend you seek qualified legal advice on the matter. I am not touting for business on behalf of any company that can assist you but my preference would be http://www.childsupportadvice.co.uk

    I must warn you they may charge for any advice but you will find all of the other companies also charge. Any company offering free qualified legal advice unless they are a charity I would be wary of. No company can operate with out making a profit.
