I pay maintanance to my ex who owes me over £3,000 !

    Just wondered if anyone else has experienced this.... I have 3 children to my ex, we split nearly 10 years ago, he paid maintanance in the very beginning but not for long, he's always been an odd job kind of bloke working self employed, so never got anywhere with the CSA.
    About 4 years ago he became an employee and was eventually assessed for maintainance, he paid eventually for about a year, then left his job, went back S/E and stopped his payments, building up a debt (To date) of over £3,000.
    The CSA obtained a liability order when the debt was over £2,000, but then my teenager went to live with dad, so because he now has a minor living with him(to cut a long story short) apparentley there is nothing the CSA can do to enforce payments.
    I have since been assessed for payments to my son, and i have made my payments everytime, on time.
    My second teenager has now gone to dads and he is going to apply for me to pay for our second child now.
    I'm not saying i don't want to pay for my children, because I am responsible for them and I should pay....it's just so unjustified that I am paying money to someone who owes me over 3grand !!!!!!
    I'm told if i had a debt to them i could offset this against his debt, but I don't see why i should be taken to court for a debt and get my name blacklisted (After working hard to clear my debts and rebuild my credit)
    Quite annoying really !!!!!

  2. The CSA can set your liability against his debt. As with most unusual CSA issues, this is not well known in the agency, so you need to push the CSA in writing on this issue

    But i don't have a liability, i pay my maintanance to my ex.

    Should i stop paying, build up a debt and then offset (which sounds bad, because I feel as though i'd be letting my kids down by not paying) but at the end of the day, he has only paid 18mths out of 10years and he felt no guilt.

    And would the csa have to take me to court for me to have a liability? Because i don't want to end up blacklisted.
    I've worked hard to get my credit status built back up.
