Who is the child benefit being paid too, if it is you then you dont have to pay csa. If your son has left school then CSA stops. I have just read a not above about someone saying for you not to disclose tax credits as they will take them into account. You can argue that your son stays with you, if he does then it is classed as shared care. He has to be staying with you for 2 nights or more a week. Yes i would counter act this claim on your ex and go for CSA from him he is working. You are on tax credits so this means that your income will not be taken into consideration but his full wages will. If you do this now then he will be on the new system and he will not be entitled to claim for any housing costs or travel to work. You can claim 15% of his wages for one child. He will have to prove that he stays in his care for more that 2 nights if he does then is payment will be reduced by a daily rate. Go for it claim csa yourself you have nothing to lose, if you claim the child benefit then you have a good case.
