Ex Partner has been made redundant and stopped maintenance

    My ex partner (Father of my three children) has just been made redundant and has this month stopped paying his csa maintenance. This will leave me in a very poor financial position, I have todate not contacted the csa and am looking for advice on any additional financial support I may be able to obtain from the goverment.

    I work less than 16 hours a week (2 jobs - Lollipop lady and Dinner Lady and alos a non profit making childrens club one day a week) 3 children two in full time education (12 and 17)get child tax credit and discounted community charge rebate. The maintenance money basically paid 50% of the mortgage with this disapating I could become in a financial mess in a matter of weeks. Any ideas?

    It's not much but the NRP will get stopped £5 per week out of his benefits. You say you haven't contacted the CSA but if the NRP has not advised them he is now on benefits, they will continue to hound him for the normal weekly amount. It is in his interest ( and legal duty) to report a change in circumstance.
    From your perspective, the NRP remains on their system and cannot dissapear so when he gets a new job, the maintenace will go back up.

    He is claiming no benefits currently ? But living with a new partner who appears to be funding his lifestyle.. will he be liable for all the arrears once and if he returns to work. He has had a substantial redundancy payment circa £6k will this be taken into account?

    Statutory redundancy is not classed as 'earnings' whereas ‘contractual’ maternity, paternity, redundancy pay, is classed as ‘earnings’ and can be subjected to deductions for child maintenance.
    I'm puzzled though as to how the CSA would work out a weekly figure from a lump sum, now that the NRP is out of work, assuming the redundancy was 'contractual'.
    If he paid maintenance up to the time he was made redundant, there will be no arrears.
    If arrears have accrued, they will probably be paid off gradually over an agreed period.The CSA don't, to my knowledge, let anyone off anything.

    As far as i know redundancy pay cant be touched. Taxed or not
