My friend has just had his bank account cleared out (£1000) he has to attend court shortly over arrears, He was one of the people that thought he could get away with not paying the xwife and just gave money to the children, in fact he gave them whatever they wanted. They are now both in their twenties and the CSA are still claiming the arrears. He had a court agreement that he would receive 7% of the marital home when the children left home (they both still live there). Is there anything he can do or will he go to prison? he is on the verge of a nervous break down.

Anyone who has CSA on their backs should never give any money to the children as this is deemed as a gift not money to support them this is the way CSA look at this. Always give it to your ex and make sure it is not cash but DD or cheque. Paper Trail. Then she can give it to the kids.

Yes you still have to pay the arrears and they will go after you until they are all paid. Sorry.

Change your bank. You dont have to give them your account no. Tell them that you will be paying them by cheque or postal order. If they dont have your account no. how can they get it. You are not refusing to pay just you want a different option of paying your arrears.

You havent told me your back ground so i cant really help you at the moment.

Your children are not children anymore. They are in their twenties. You can force your wife to sell the home and half of this is legally yours i.e. if your name is on this. They will take whatever the arrears is owing out of this.

I need to know why you signed an agreement for just 7% of the home.

Are you working or not working.

Please send me some more info regarding your case so that i can help you.

Can the csa take money if the account is in joint names or even someone else's, i.e. new wife? Thanks
