CSA Arrears from over 15 years ago!!

    My husband has been advised by the CSA that he has £19k of arrears dating back to 1994. He has always paid maintenance by standing order to his ex wife, which was an agreed amount between both of them, so we can't understand why the CSA are even involved. The amount he was paying (his kids are now 23 and 21)is not as much as the CSA said he should have been paying, but I don't see how this matters if it was agreed between both of them. We contacted our MP and they also contacted the CSA on his behalf and they reviewed the amount and reduced it (they originally said it was £35k)! However they are demanding that he pay it in full or they will apply for a court order and get the baliffs in! I am really worried about this as we have a 4 year old daughter and my husband has just been made redundant. He is willing to pay it off as much as we can afford but they say it's not enough. If the baillifs do come in can they take goods from the house even though effectively they are half mine and it's not my debt. Can the court order you to sell your house even though it's a part buy / part rent property and the mortgage is in joint names? I think it's disgusting that a Government agency doesn't care that they could be making people homeless, not caring if you get into vast amounts of debt (they have said he can pay by credit card) and causing children to live in poverty, which we will be the case if this all goes their way. Please can anyone help with any advice at all as we have found them so frustrating to deal with. Many thanks.

    I can only sympathise with you because we are in the same position just now. I don't know if they would force you to sell the house or just put an order over it which would stop you selling it as they would take their debt from it. You are totally right that they don't seem to care that people are homeless or living under the breadline because of their ridiculous calculations and errors. Surely they should only look at your husband's income to see how much he can repay? Do you have savings etc. that they would try to take?

    Hi. Likewise I'm in the same boat, my ex got her case reviewed and as a result my payments have trebled and I have £3000 arrears despite never missing a payment and being with the same employer (my wages have gone up by only around 15% since the last review 7 years ago). I see my kids twice a week and have spent much more than that on them over the past 7 years, yet this isn't taken into consideration. I'm obviously fighting it on the grounds that if they don't review cases annually then it is unfair to claim "arrears" many years later.

    If reviewed surly they can only backdate to the date they review the case????? Im reading your stories and am very pale - sorry for all of you - as for maisiesmum surly the ex can call them off - in 1994 she must have contacted them (did she claim benefits for this period) the case has to be "opened" for the csa to get involved and if you had a private agreement and can prove you have made payments via Direct debit then they have to take these payments as they stand .... paid. Ask for a breakdown of arrears to see exactly how they came to this figure! do they know you have a child at home??? They HAVE TO LEAVE YOU with 60% of your income - tho' 40% is still a lot to take - see if the ex will contact them on your behalf and tell them you have a direct debit.

    csa fighter - ask them to review it again - if she can have a review so can you - do youtr children stay over night???? if so you will get a reduction, do you travel far to see them??> again you will get a reduction and have you any children living with you??? get a statement asking them exactley how they came up with the sum you earn if your last review was 7 yrs ago are they backdating that it far??? is so show 'em your p60 for that yr to show your wages 7yrs ago were not increased??? it may help???
