Daughter 17yr in education (not sure of hours/week)living with her aunt who receives child benefit for her. I have received a claim form from CSA but a week ago I received 6 letters on one day from CSA for my outstanding claim with ex for 17 yr old and 2 other daughters. Currently one daughter lives with me, one with her boyfriend and the 17 yr old with my sister.
I called the csa to try to obtain payment from my slippery ex but was informed that I needed to complete the new claim else the courts would be on my back. I have been paying money to my daughter directly (as recommended by my sister who is a benefits expert...)which I stopped when the CSA called me.
It is likely that the oustanding amounts from my ex will be paid when he receives a court appearance letter but the money due is for a time when I was not working.
I am the only one working in my house and have my 15 yr old with me.
My 17 old is likely to go abroad to work in Feb, as her course finishes, she will be 19 in Spring 2013.
I called the CSA last night and was told that I will have to divulge my salary and set up paymenst to my sister and that payments would continue even when my daughter is out of the country and so too would the child benefit.
Surely this is unfair?
I work through an umbrella company and my salary varies as I am paid for the hours I work. So over Christmas I shall not be earning anything and my contract finishes mid Jan and I do not have another contract to go to.
If a payment scheme is set up based on my 5 previous take home pay, minus my expenses some weeks I will not have enough money to pay.
I was told by the CSA that my sister also has a claim against my ex and was told that she could get 30% between the two payments.
Is this the case?
Do any of you know what the rules are in such cases?
I was told that my daughter would have to take up perm residency abroad for payments to stop.
Why should I work to pay for sister for nothing?
