child is no longer in mothers care

    ok not sure where to start. My ex and i have been divorced for about 18 months and i have been paying csa since then! my son is now not living with his mother as she kicked him out so he living with his cousin as i am not living in a place which would be suitable for him to be in, so until i can sort myself out he'll be staying there. now my ex has a new partner and they also have a baby! obviously im not comfortable with still paying her child support if its to pay for her new man and there new baby if my son is not in his family home! is there anyway way for me to stop it or would he have to be in my care full time? any advice is good advice!!

    In my experience, if your ex is receiving child benefit for your son (regardless of where he lives), then she can apply for and claim csa payments.

    You can only pay someone else if they put a claim in themselves and they've usually to be in receipt of the child benefit.

    I think you will have to keep paying while ever you are the parent without care.

    Ask to have the case closed. If your son is not living with your ex then she should not be in receipt of payment.

    If she isn't in receipt of child benefit, then she shouldn't be receiving maintanance, but if she is recieving child benefit, then the CSA say she is entitled to maintanance and they won't close the case and if you stop making payments you will accumulate a debt.

    My daughter moved in with her dad, I paid for her, she then went to live with her nan, and I questioned the same thing, but because her dad was still receiving the child benefit for our daughter, i still had to pay my daughters dad.

  5. The right to receive child support is soley linked to nights care. Child benefit is irrelevant, but is a guidline indicating who has the care. You will need to appeal in writing and find some evidence to support your case...
