Charging Order on OUR home

    Where do I start?

    My partner and I met 2 years after his divorce. His ex wife was being a bit*h and wouldn't let him see the children and as a consequence of this and that, she went to the CSA and told him under no circumstances would she let him get away with it and she would make him pay for as long as necessary (he stopped paying because she refused access etcetc for 4 years). We have been through many court appeals, tribunals MP's solicitors etc etc. (Did I mention she got the house, brought and paid for in a lovely leafy suburb in London?). Originally, the CSA were happy with his payments. She wasnt and went to Tribunal. They took into account HER information about HIS lifestyle (they had been divroced and living apart for 18 mths)and decided, without any evidence, that she ws right and he owed arrears in the region of £10,000.

    The tribunal agree that although their findings were wrong, they were wrong in fact, not in law (basically they have admitted to making a mistake in the arrears, but DO NOT have to change it because of the way in which the decision was made). They have now passed it back to the CSA who have today issued a charging order against OUR jointly owed home.

    Even though he pays every month, they are claiming he now owes in excess of £20,000, which will be recovered from the sale of OUR home if we ever sell it.

    Our solicitor has told us the only way to fight the tribunal is through the High Court?

    Any advice as to what we can do - I'm losing the will to live.............

    Sorry, I should point out that my partner pays for his children and always has - just not the amount she wanted (£250 a week).

    I have just spoken to a debt advice line who tell me that there is nothing I can do and the charging order will stand. GREAT!
