Charging order - court appearance

    Hope somebody could assist me with this. I have arrears for around £6k with our dear, dear friends at the CSA. As a result, I've been asked to attend a court hearing early next year with regards to them placing a charging order on our house. The case itself is now closed so it's 'just' the arrears they're after.

    I've made countless offers of payment, but none fell within the 'guidelined' two years. I have never refused to pay, period. But I've been unemployed for two years now due to health reasons, and as a consequence, they haven't received any payments in that time. I'm not a dodger, I want this done and dusted more than anyone.

    My question(s) is this. What exactly can I expect when I appear? Would it be wise to make a, reasonable, offer to pay? Surely a judge will be more understanding than the CSA robots?

    I'm going into this pretty much blind, so any pointers at all would be appreciated. Thanks in advance.

    What have they actually sent you? Do they already have a Liability Order against you? If they are applying for a Liability Order then you can defend the case. If they already have a Liability Order against you then they are applying to the Court to use Bailiffs etc to obtain the money. Need some more info please.

    Hi. Thanks for the reply.

    The letter says: Please find enclosed an Interim Order and Notice to attend a hearing on etc etc. The next page: The court orders that the interest of the judgment debtor (me) in the asset described in the schedule below stand charged with payment £6k etc etc. The address of the land or property charged is (my address) etc etc.

    They already have a Liability Order against you! Did you go to Court to defend it? If you didn't bother to turn up you've got yourself in deep shit. They've already got a Court Order against you saying that you owe the money. What is the amount that you owe? You say that it's at least £6k. When is the Court hearing? What you now have to do is go to Court and show why they can't take your house, car or other belongings off you. If you don't pay they WILL send bailiffs around to collect your items. Put your post up on CsaHell on Facebook urgently, you will get a lot more replies from people who've been there.

    Of course I went to court! The 'big' court. I went suited, booted and armed with a folder full of DPF's and the like. I even conversed with a CSA representative prior to my appearance and argued my case. To cut this short, the whole procedure was merely a 'rubber stamping' exercise. I even asked her if it was worth my 'taking the stand'. She said no. Basically, she completely disregarded anything I had to say or argue or prove. The whole thing was absolutely pointless. But that doesn't make the shit any shallower! I'll try again when my appearance date comes around. Maybe they'll listen?

    I won't be plastering this all over facebook, for obvious reasons. But again, thanks for your time. And good luck everyone.
