Hi All,
Sorry, I've had a quick look through the posts and can't seem to find information on this, so wondering if anyone knows...
Background is my boyfriend has 2 kids, and had been paying his ex directly, an agreed amount between them monthly. He lost his job so could no longer pay the agreed amount, see then went to CSA, they calculated he owed £9k, based on they had no record of any payments (which technically isn't their fault)! Boyfriend then called CSA, after lots of calls last year, csa wrote a letter amendeing amount due to £2k, which was about right, however he lost the letter (had to move out of house as couldn't afford rent!). Then this year the csa got in touch again saying he owed £9k, he rang them up and they said they had no record of this amended arrears, have since taken him to court, a liability order.
He tried getting information out of csa about how they were working out the amount, but never seemed to get very far over the phone. However I have recently seen you can get your file appealed and thoroughly looked at. But you have to apply within a month of recieving the letter from the csa. Now the letter saying he owes £9k is over a month, however the liability order is recent? Can we use that letter for them to review his case?
Please know I am not contesting the fact he owes money, or should pay, however I am contesting they have not taken previous payments into account. Is it to late?
Any advice would be appreciated.
Kind Regards
