I have been paying the CSA now for over 10 years which some were arrears of over 9K. I have got the 9k down to around 5K. My child was taken away from her mother by social services and put in care by order of the courts over 5 years ago and these arrears were from before then which I am still paying for.

Do I still have to pay these arrears? Even when It was being payed out for the mother to look after the child, when it came to pass she obviously was not at the time hence the above.

    many thanks

Yes, because you still owe that money. What you owe is classed as arrears and not current payments.

yes you still have to pay arrears. Have you looked into the amount that you had to pay in the first place. How do you know if your assessment was correct.

I would contact income support and tell them that you are paying your ex this money and the child is not there. This should be taken into account as money coming into her house and then in turn this would be a reduction in her income support.

Ask for a copy of all your assessments dating back to the beginning when csa first took money of you. Send a letter recorded delivery to the data protection section of the csa and ask for all your details. They have to reply within 40 days. good reading but it is worth it if they owe you money. I done it for my partner and i got him back 80,000 over a period of 16 yrs of csa wanting arrears. They didint get it.

    good luck
