Arrears.

    I am being screwed for arrears to a order that ended in 09/2008. I had an attachment of earnings for many, many years but have been ORDERED (bullied into) to pay £22:00 per week for the next 104 weeks. I begged the question as to how I have such arrears & was fobbed off with aggressive intimidating responses & told in no uncertain terms that if I did not agree to pay the arrears back at these rates, I would be forced to pay the arrears back at £101:50 per week until 08/2010. I even went to the appeals court in Leicester many years ago to contest arrears at the beginning of the order & WON my case to have a deferment of arrears issued but this has not been recognised. I have therefore began to re-pay £2288 to THE SECRETARY OF STATE that I can ill afford to pay as it is! Does anybody have any suggestions please?

    your rights were recognised by the appeal and ignored by the CSA...sounds like a clear cut case for the European court for Human rights

    Yet again throughout these post I see 2 years to pay arrears but the CSA will not tell you that it is written into CSA law.

    The two year repayment is a guideline that case workers are put under pressure to stick to. It isn't law.

    Ask for a breakdown of the how they calculate the arrears and the payments made, Can the case be taken to appeals again??? Does the order of appeals cover the years 08/09 or other years??? I would seek legal advice, the cab, and your mp.
