Anyone got any advice.

    My partners up until a week ago paid his ex £50 a week . By the CSA calculater he was only supposed to pay £36. Before christmas he was made redundant but the company took him on self employed so they can basically use him as they needed to he has done this until he finds other employment. Since then (october) he has sometimes worked 2 day 3 days or sometimes 5 days. Unforunetly a week a go I lost one of my jobs (i have 2), so and because we have both now lost earnings we were unable to pay £50 so my partner has took the money down to £36 which is still more than she should be getting by the csa calculater as this is what she should have got to start with when he was in full time employment which at the moment he isnt doing his hours etc are very unrealiable. His ex basically isnt happy and is going to the CSA to try and get more money. My question is if his hours are unrealiable etc how would they calculate it. I have been told she will most definately be worse off by using CSA.

    she probably will be worse off, ring the csa up speak to someone & they should tell you how they would access his earning with being irregular hours, make sure you get the name of the person you speak to and which office you are talking to.

    i have just been told tha a case closed 3 yrs ago has been re opened, and that i will have to pay 9 grand. i also have a letter fron 2008 telling me my case was closed, how do they get away with this! im at my wits end i have payed for my kids since 1992 and thought id finished in 2007,i now have to pay £449, per mnth. do the csa really know the trouble they cause.

    David, they are doing this to everyone at the moment! They are trying to collect in as much money as is possible even when the figures are fictitious. You will probably find that some years ago, they did an assessment while you were working and you then left, or lost your job and went onto benefit. Although the CSA were informed that you were on benefit, the case officer will have left he assessment running rather than reassessing it to zero. Hence building up huge arrears month by month. This is because if the case officer reduced your assessment that case officer would lose their bonus. Just as salesmen in the financial services sell people the wrong product because there is more commission on that product!

    1. Write back (don't phone) to the office dealing with your case, stating that the arrears fictitious and that the case was closed in 2008. Then ask them to provide a full details of each assessment, as to how it was calculated, and a full break down of the arrears within fourteen days.

    2. Write to the CSA Longbenton, and ask for a complete copy of your file, under the Data Protection Act, state your NI number, enclose a postal order for £10, and ask for copies of all letters, emails, assessments, and a full copy of all computer records. Also ask for the computer log to be properly dated.

    3. Get what's happened down in writing, a summary, make an appointment to see your MP and go see him, now!

    This a start, come back on here as you progress and also if the CSA start making further threats, eg DEOs, Liability Orders, Court Action etc. If they try to make any of the above, you need to be in Court quickly to get them set aside.

    By the way, the CSA staff thoroughly enjoy doing this, and love bragging about taking peoples homes off them etc.
