<description>&#60;p&#62;my son is 28 and no contact from csa for 12yrs till they said i owed 18k in arrears.contact you local mp mine has been really helpful and only deal with the csa  by letter so you have proof of what they say you owe as it changes every letter and assesment!.look on your local mp website as to whom to complain to and write to all of them!(registered post)don't give up/in to there threats/demands till your happy with what you owe.

<description>&#60;p&#62;Have you resolved this issue? only my My brother in law is being chased for nearly £30.000 in arrears which we think is not due. His son is now 26 years old so should no longer be on the system. He split from his partner when his son was 8 and paid via his employers up unitl he was made redundent in 2001, we have calculated that he his total liability would only have been some £14,000 and as he was unemployed for the last 2 years of his sons school life he should not owe anything. My question is what can he do? they are calling his eldery mother (she is 84) They are demanding payment or face legal action. Could somebody please sugest what he should do? He has no money and would not be able to pay for any costs the courts may impose. Thanks in advance

In these situations, the regulation is said to be made ‘ultra vires.’ This translates as ‘beyond the scope of its powers.’&#60;br /&#62;
 The courts, child support commissioners and tribunals, as well as the CSA itself and JobCentre Plus are all under a duty to follow the law. In some cases, however, the domestic law may not be entirely compatible with European law. Decisions that are made contrary to European legislation are wrong in law. In practice, the law of the European Court of Human Rights is more likely to be applicable in child support cases than European Union law. In the case of EU law relating to the equality of men and women regarding social security matters, commissioners have determined that this does not apply in the realm of child maintenance issues.&#60;br /&#62;
In terms of human rights law (ECHR), the domestic courts are required to interpret this in so far as is possible to do so. Courts, and child support commissioners, are not able to override the European law in order to ‘fit’ with the domestic law. If EU and UK law are found to be incompatible with one another, the courts can declare this incompatibility”.
