Hello Everyone. I am new to this site and to C.S.A. I have tried desperately to avoid going to C.S.A. but my ex pays me maybe £40-£50 a YEAR! I tried to make arrangements that were amicable between us and only asked him for £25 per week. Just to pay for basics or any trips they may have. My boys are 10 and 5. Expensive ages and I know it will only get worse. When I ask him to look after the kids he says he is working. When I ask him for money for that week he says he hasn't had any work. He does have the boys every other weekend so I have no complaints there. The problem is he pays nothing and I have to move out of my house so the boys can spend the weekend with their dad because he lives with his mummy and daddy (because he refused to pay his bills and lost his flat). I know he is taking advantage of the situation but surely this isn't right or normal for that matter. I have decided that in the New Year I will give him 6 months to find his own place or he will just have to pick the kids up in the morning and bring them back at night time and also I have decided to go to C.S.A. Even if he doesn't work he should be getting JSA right??? My fiance has 2 girls and pays over £400 per month for them and can't even see them because he wont talk to their mother. I see my ex husband doing what he is doing and see my fiance going through what he is going through and it seems so UNFAIR!! Am I right to finally stand up and sort this out? Will I be able to get anything from him if he is self employed?????

Do make yourself aware of the tax implications here. However, this can work BUT the company has to pay dividends, which would be subject to a reg 19 variation. Of course in the current market the profits from renting won't be 8% net so for big property owners it can be a beneficial course of action...

I understand that if you divert asses to a Limited company, then it may not be exempt. Also the tax on the property, if let or sold, may be be subject to corporation tax and or capital gains tax. In essence a property held in a company is treated differently. The taxcafe has useful advice

I was wonder how it would work out if you own property through a Limited Company.
Because a Limited Company is it's own legal entity,(legal person) in theory the CSA should'nt be able to access assests held in the company.

The CSA are incompetent and not above subversion and bullying.Be very careful in dealing with them by telephone. It would be much better to only contact them by letter.
The CSA will not be interested in how long you have known the mother or whether you ever co-habitated. If you doubt parentaged - get a test, as disproving parentaged would be the quickest method of closing out the case. I've been over-assessed for 3 years and the CSA have yet to resolve my case.
For the S/Employed, the assessment is usually based on the latest available set of trading figures, but I am unsure how they would assess you in your first year of business. The assessment is however based on income after allowable business expenditure, so you could minimise income by buying as many tools/instruments as you can afford and by only working part of the year.
Another option would be to start a Limited Company and become an Employee of that company and pay yourself the minimum wage. This is a much more straightforward method of dealing with the CSA, as you can say to them I'm earning X per week and the assessment can be worked out quicker.
If you stay S/Employed, you will have to find a lump sum to make a payment on account.
Whatever you pay to either woman, pay them DIRECRTLY and in a way you can prove e.g cheque. Do not make payments to a third party like bank (mortgage) or landlord (rent)as these payments may not count.

hi i have just gone self employed as i was made redundantfrom my other job
i have a little boy with my ex partner and a girl with a new partner who i have split with before she was born as after eight weeks of knowing her she got pregnant!!!!i wasnt living with er so dont even know if its mine she is now hownding me with the csa.my little boys mum is ok with what i give her as if he needs shoes ect i get it and also i have what ever contact with him but the other woman wont even let me see the girl and wants all my money.
how does the self employed thing work with the csa
many thanks andy

also i've looked at the csa calculator and after they'll have taken money for both my children and i've paid my fuel for the week half my wages will have gone. i knowi can claim my fuel and work expenses back but thats not till the end of the tax year, also i was planning on putting some money aside in the bank each week incase my tax bill is higher than what i'll have paid. seems to me i'm going to be worse off working self employed than i was as an empolyee on a firms books but in the job i do there isn't any jobs on the books.

I have recently posted a reply and joined the forum, after this weeks CSA introduction.

I am contemplating (no choice really) becoming unemployed, and becoming a self employed person, and I am after any guidance or advice on the outcome of this decision.

I am meeting with the CSA (1st time)next week, and I am not optimistic that they will change the "Attatchment to earnings" figure that has been put together since Tuesday of this week, probably even after showing them my outgoings (they took bank A/C details, salary details, personal details, calendars etc - without my knowledge, but within the Law, as my employer explained (as it was explained to him.)

If anyone has any advice for me - i would appreciate it - Thanks chair12345
