HI

I have been fighting with the CSA for 10 years now for payments for my son. My ex husband has left jobs to dodge his responsibilities, gone undercover so he can't be found etc. The CSA seem to have little power to find him.

He now owes over £9,000 and left his job again 8 mths ago. The CSA have just caught up with him and he says he is unemployed and has no income coming in. I know this is rubbish as he has a mortgage and other children to support but the CSA take his word for it and will not question what he says!

Yet again my son misses out!

This system that the CSA have is Unethical and I want to challenge it with the support of parents fighting for their children. I need strong backing from everyone who is having trouble from Non Resident parents that are dodging their responsibilities regarding paying for their children; be them male or female.

If you have a CSA story please email me telling me your experience with the CSA. Please include your name and address( I may need to contact you) . If I can get enough evidence from people detailing how incompetent the CSA is I will contact my local MP and campaign to change the system. PLEASE BACK THIS CAUSE FOR THE SAKE OF ALL THE CHILDREN WHO ARE MISSING OUT!

If anyone is interested in doing this with me please let me know. The more of us involved in this the better. I know how stressful dealing with the Child Support Agency is. Its 2012 and the agency is still as incompetent as when it started!

If people are committing benefit fraud they face consequences. If people are not financially supporting their children they can walk away - this isn't right!

PLEASE EMAIL ME YOUR EXPERIENCES THAT YOU HAVE HAD WITH THE CSA (please include your name and address)

Stop the CSA from creating NRP and NRPP financial hardship and poverty

Responsible department: Department for Work and Pensions

The CSA/ CMEC are responsible for creating financial hardship and poverty to the NRP and NRPP and their children. They take so much money with no regard to other financial responsibilities. They also take some of the child tax credit from the NRP and their family. The CSA/ CMEC are creating poverty they rob Peter to pay Paul. Fairer and sensible, reasonable affordable, child maintenance payments must be negotiated with the NRP. A fairer system must be installed and prevention of the PWC using the CSA/ CMEC as a tool of vindication and a cash cow.

What you have said so far discloses no actual defence. You need to show its reasonable to retain the property but pay no child support on it, for instance if its going to be your home when the tenancy comes to a close.

The divorces ancillary relief allocated a good chunk of the marital assets to the PWC, but the NRP gained rental property in the division. The NRP is now subject to the CSA 8% interest on equity variation order. The NRP is already paying a large amount of child maintenance through the CSA and a variation is neither just nor equitable and property is being held for a specific purpose. The rentals are being held so that if realised the NRP actually has somewhere to live with an affordable mortgage.

WHAT IS THE BEST DEFENCE to this variation application?

You should make a formal request to have the case closed on the grounds that the Qualifying Child (QC) is no longer in education and the case should be closed. You cannot rely upon the CSA to carry out the correct checks. Just looking on the system to determine if CB is in payment is not good enough, the PWC may not have told the CB Agency. When you receive a reply, if you still have not seen real proof appeal the decision to Central Appeals Unit (CAU) who in turn will request written evidence from the PWC about which education establishment the QC is attending. If the PWC cannot provide the evidence the CAU will lapse the appeal in your favour and close the case. If the PWC does provide the evidence then you can withdraw the appeal. Doing it this way lets you actual see that the matter has been investigated fully.

Ring the CSA and get them to check this for you. They will do a child benefit check. As a general rule then if this is still in payment then the child is still in full time education. If not, then the case needs to be closed.

If child benefit is still in payment ask what the expiry date is and contact them again after that time.

I am an NRP with a child that turned 16 on 16th August 2011.

I have no contact with either the child or his mother since 1996 by mutual consent.

If my child had ceased compulsory education [secondary school] at full term, my CSA payments would have stopped from September 2011 onwards, however they continue to take money and I have had no contact informing me payments have stopped.

I can only assume that my child has moved onto higher education [college], but how do I find this out for certain, and that the CSA are not erranously continuing to take payments from me?

I thought I would put my side of the story on here as it seems to be mostly NRPs venting about the CSA getting their side of things wrong. I do both sympathise and empathise with everyone who has to deal with the administrative nightmare that is the CSA, but I also think that there are some NRPs that make getting maintenance payments virtually impossible.

Our situation is that my step child lives with us, and has no contact with his mother. This is for two reasons - one was the choice of my step child, the other was the complete lack of contact from the NRP. She seems to be under the impression that gives her the right not to pay, an attitude that I don't really understand as the last time I checked, it was not my responsibility to pay for someone else's child. Of course, this sounds very harsh and of course I am happy to do it as I have come to be the 'real' mother in this situation but frequently become unhappy when I think about what she is getting away with.

To publish the catalogue of problems we have had, both due to her unwillingness to cooperate and mistakes made by the CSA would take far too long, but I can safely say that although involving one's MP certainly speeds up certain processes, it does not resolve the situation if the NRP is using delaying tactics.

I really don't know what to do anymore. Our regular payment is base rate, and the arrears that she owes us, which amounts to somewhere in the region of £2,000 is being paid off at a rate of roughly £3 per month. You don't have to be a genius to work out that that will take a vast amount of time to clear. Luckily, we don't need the money, but we are entitled to it so I think the fact that we don't rely on it is entirely irrelevant; there may come a time when we do need that amount of money. If we were a credit card company, we'd be able to use the courts and solicitors to recover the debt. Unfortunately we don't have the time or resources to do that, coupled with the fact that this is supposed to be what the CSA can do, yet two years down the line, we are still waiting for a liability order to be granted.

I just wanted to let people know that PWCs cannot always 'do what they like' or 'get away with murder'. Sometimes it is those NRPs who have no emotional, physical or financial input that get off relatively unscathed. And if she was really that bothered about seeing her child, I'm sure she'd make some kind of effort.
