<description>&#60;p&#62;It is with sadness that I write for advice as it may seem petty however we would rather base our decisions upon fact than emotion and with fact we can make an informed decision on how to proceed or come to an agreement.&#60;/p&#62;
&#60;p&#62;The issue has come about as my parter and I use child maintainence in completely different ways.&#60;/p&#62;
&#60;p&#62;In my case I use my child maintenance payments from my ex husband to cover everything, all clothes, after school childacare, uniform, extra curricular activities etc etc. This works well and if my ex partner choses to buy anything additional for our daughter that is his choice but not a necessity. He has the basics at his home that he has purchased ie a few spare pants, socks, tooth brush however I pack a bag for her everytime she is in his care and he sends everything back. &#60;/p&#62;
&#60;p&#62;My partners ex wife has put to us that she believes that when the children are with the NRP they should have their own clothing in that house (purchased by NRP), that extra curricular activities should be paid for on the days when they are in the care of the NRP and that after school childcare should also be paid for on days of care of the NRP. This also includes school dinners on those days and the list goes on. &#60;/p&#62;
&#60;p&#62;We have the children for 5 nights in a fortnight. My partner pays maintenance of 20% net income for the 2 boys reduced by the number of nights we have them per csa guidlines.&#60;/p&#62;
&#60;p&#62;All parties work full time so childcare is a Mon-Fri every week.&#60;/p&#62;
&#60;p&#62;Can anybody help with a defined list of what is or isn&#38;#039;t covered by maintenance.&#60;/p&#62;
&#60;p&#62;It would be great to have an official leaflet or website so that we can come to a mutual agreement&#60;/p&#62;

<description>&#60;p&#62;There are a few queries raised here Vic, firstly was the money paid through the CSA in the first case? as it sounds like it was paid direct to the parent by cheque, which is more in line with a private arrangement than CSA.&#60;br /&#62;
Secondly is there any arrears owing through the CSA? if there is they do have greater means of taking more money than seems fair by a variety of methods, although I will state I'm not sure if arresting ALL of the JSA is one of them.&#60;br /&#62;
What was the CSA calculated rate whilst he was earning? Was the full amount being paid causing arrears?&#60;br /&#62;
As a general rule of thumb, if the Non Resident Parent is on JSA they will take £5 week base rate, but there are circumstances the CSA can enforce to take more, such as arrears, and they are known to consider why a person is on JSA as to whether they want to amend the set amount.&#60;br /&#62;
Sorry to be so woolly, but there are some points here which need to be clarified to know exactly what is right and wrong before anything else can be said or done.

He currently lives with me and my measely wage of £900 has been supporting us both for quite some time.  Anyhow, he went to sign on for the first time 8 weeks ago, his third sign on date was last wendesday with the money expected in today, he has signed on three times and has never recieved his JSA, He told me that the CSA have arrested it all, can they do this???? i mean i know they can arrest something but 3 giros and leave him with nothing?  it cant be right, tbh i just want to check out for myself and he has a history of lying especially when it comes to money and he has got a drinking addiction, he could be getting it paid into another account and just spinning me another line, id like to believe him but i need black and white proof these days

I have even sent them proof of this recipts for 2004 to 06  there top lady was supposed to contact me back two weeks ago today but dident and today i get this letter . i give my veihcle to my brother for a pound why should i pay twice this insult and breach of my human rights .! pissed off now very .

<description>&#60;p&#62;have they diclosed any information about your case to the armed forces. if so then they have breached the data protection act. armed  forces or not they can not discuss any of the case with them, what have they told them about it or is it a (deo)that they are asking for.&#60;/p&#62;
&#60;p&#62;the first thing to do is ask for an independant (hearing)tribunal you must have grounds for appeal. ar you on CSA1 30% or CS2 15% it will make a differance to the amount. the appeal must be a hearing they fucking hate it but it is your right to do that. also recorded delivery on letters no more phone calls. you must act soon for the appesal it could take another 12months to deal with.&#60;/p&#62;
&#60;p&#62;your appeal will be dependant on cs1 as cs2 is 15% of earnings only.&#60;br /&#62;
i do believe that if you are in the TA they can not take that money but i will look in to it for you. keep you posted&#60;/p&#62;

<description>&#60;p&#62;I am currently serving a 6 month tour of the falklands and have recently, 5th march 09, been called into an interveiw with my squadron leader(married mother). The interveiw concerned a letter received from the CSA via the service and veterans agency in which they wanted to take approx £450 per month from my wage. the letter did not say what this was for, my squadron leader who henceforth shall be referred to as Jabba expected me to sign and just say yes, when I refused and said I would be disputing everything she looked at me as if I had asked if it would be ok for gary glitter to stand in for babysitting duties for me! I am in the territorial army and so normally in civilian life I am a self employed electrician so it would be easier at home for me to evade the csa if I chose to do so, the military are an easy target for the csa and receive more injuries  mentally than they get in any conflict.I have had dealings with the csa previously and would say to anyone caught up in this war-DO NOT GIVE UP- I know it can be draining but do not let the bastards get you down and if you know or meet anyone who works for the csa then please spit in their face and just remind them of the misery they bring to the lives of people who are just trying to live their lives

<description>&#60;p&#62;I was in a similar position a few years ago. My wages dropped from between £450 - £550 a week to just over £200. I just about begged them to half the payments from £60 a week to £30. They refused so I told them I would lose my car and wouldn't be able to get to work. To this they responded with 'Your car is not the problem of the CSA'. I said that if I didn't have a car I wouldn't be able to get to work and thus couldn't pay maintainance. The response was 'Thats not our problem' of which to me sums up the CSA as a bunch of incompetent idiots. I then said that I would have to finish work and go on benefits. To this they said that if I did that they would contact the DWP and inform them that because of CSA involvement I put myself on benefits and I would receive no money! In the end the stress and depression got to much and I had to sign off sick. That was nearly 2 years ago and I am still being hounded by them!

Our son is dressed in 2nd hand clothes &#38;#38; dosen't get birthday or christmas presents from us because we cannot afford it, and I have approx £50 - £100 ( if i can wangle it) a month for food &#38;#38; nappies &#38;#38; guess what CSA told me, they didn;t care about my child he had to pay for the one on their books! Top it all my husband is out fighting for this country in Afghanastan - whats the point! Untill they get rid off the old system totally honest people are going to get screwed even more!

<description>&#60;p&#62;They will try to deduct it direct from your pay using a deduction from earnings order (DEO) so it might be best to quit your job. Many people have had to do that as they cannot afford to work. I'm in the same boat, paying 40% of my wages, which I can't afford.&#60;/p&#62;
&#60;p&#62;I've sent in countless letters and just had the same ignorant responses. I will have to quit in the next few weeks if I don't get a resolution to my last letter.&#60;/p&#62;

<description>&#60;p&#62;CSA case workers never phone you back. They seem to want it to get to the stage where they automatically deduct money from your wages and go through the courts.&#60;/p&#62;
&#60;p&#62;Record every phone call, take down times, dates and names of who you speak to. Your best weapon is proof that you've done everything you can to contact them and that they are at fault.&#60;/p&#62;

<description>&#60;p&#62;Have you been recording details of who you have spoken to, with times, dates and names of each person you've talked to and what they have said? The CSA is a mess of an organisation and they'll rely on you getting mixed up, because they certainly will. &#60;/p&#62;
&#60;p&#62;Ideally you should record your phonecalls with them, then they can't lie about what was said and agreed.&#60;/p&#62;
&#60;p&#62;I'd suggest you started chronicling everything you do with regards to dealing with them, and if you can actually record the calls.&#60;/p&#62;
&#60;p&#62;They will debit your salary, make no mistake about that. They'll also take as long as possible and lose information so they can't sort it out while you're losing money. You need to get hold of them straight away.

<description>&#60;p&#62;I have been having problems with the C.S.A. I have over the past couple of months been sent various letters demanding payment for £526, for arrears for my daughter. I have called the C.S.A three times in connection with this issue, as both my children are in full time work.&#60;br /&#62;
Previous to recieving these letters, I had a private agreement with my ex wife, who may I add, forgot to tell me that my daughter had left school and was now working full time.&#60;br /&#62;
My ex wife apparently contacted the C.S.A in January saying that I have not paid, and as we all know the C.S.A take on the case for the day of the phone call.&#60;br /&#62;
So the up shot of this is, I have proof of payment of the money to my ex wife (cheque stubs and bank account details) Last payment being in March of this year, I then stopped paying as my daughter had left school and was now working. I am now being chased for April/ May payments....is it right that I have to pay, even though my daughetr left full time education on the 4th April 2008.(I have a letter from the school to confirm this)&#60;br /&#62;
Each time I call the C.S.A someone says they will sort it out, then all that happens is I recieve another letter demanding this money..I have no been threatened with a debit on my salary.&#60;br /&#62;
Help Please !!!!
