I have just looked through more info about CSA on the Direct.gov website and it says that my partner can propose someone else to contact CSA on his behalf - that would be better because I won&#38;#039;t get cross with them! (or will I? haha!) so I think we will write a letter and question the protected earnings point - it&#38;#039;s a good job we are not living together at the moment - this would cause SO many arguments between us we would have separated by now! :(

<description>&#60;p&#62;The employer receives a schedule with the amount of payments that should be deducted.  You too should have a schedule detailing how much should be taken each month with any extras added on ie arrears be them fact or fictional arrears.  &#60;/p&#62;
&#60;p&#62;Never speak on the phone, waste of time and you have no proof of what was said.  Always write to them via recorded delivery - gets expensive but at least you can prove they received it as you will have a tracking number than you can check online to see if they signed for it.&#60;/p&#62;
&#60;p&#62;If the employer are taking too much then that is another matter as they must be pocketing the extra.&#60;/p&#62;
&#60;p&#62;On the new system they can only take up to 40% of his wage and leave him with protected earnings which is the amount they deem he should be left with to live on.&#60;/p&#62;
&#60;p&#62;Check through your paperwork.&#60;/p&#62;
&#60;p&#62;If he is working for £2 he would be better off not working.  I don&#38;#039;t condone someone for jacking in a job to escape the CSA (before somebody starts ranting at me!!!), but there is no point in working for £2 that is madness.

<description>&#60;p&#62;Thanks adecentwoman, this only started in May of this year so I would guess he is on the new system - he used to be left with a good chuck (when I say a good chunk I mean about £270) and he has called and called the CSA but he gets very cross with them and as soon as he does that they hang up (can&#38;#039;t really blame them for that although they should be more empathic). I will try and get him to write to them and ask for reassessment - although I have a feeling it may be the employer who makes the calculation...so they may be at fault... (sigh)

&#60;p&#62;They should leave him with 60% of his earnings he should have protected earnings.  Is he on the old or new system?  I can only imagine he is on the old system.&#60;/p&#62;
&#60;p&#62;All I can suggest is to write to them and ask for his case to be reassessed.&#60;/p&#62;

<description>&#60;p&#62;My partner is paying for a child, and every week his deductions are taken from his gross earnings but they take it all and leave him with £2.  The CSA say that he owes &#38;quot;hundreds&#38;quot; in arrears.  The employer says there is nothing that they can do becasue the CSA demand that they make the deduction.  Isn&#38;#039;t he legally supposed to be left with £270 to live on? Is this an error of the CSA or is it the fault of the Employer who makes the calculation of payments? &#60;p&#62;They base everything on a blanket percentage of earnings because they are lazy and don&#38;#039;t care.&#60;/p&#62;
&#60;p&#62;Actually don&#38;#039;t care should be their mantra.&#60;/p&#62;
&#60;p&#62;Contact the CSA about &#38;#039;the old rules&#38;#039; as they have no right to adhere to them unless you have agreed, it could be that your ex earns less than your partner and that is why he pays less.&#60;/p&#62;
&#60;p&#62;Long gone are the days when people came to a fair agreement re child maintenance.

<description>&#60;p&#62;We are about at our wits end, My current partner has been assesed by the CSA at his ex-wife&#38;#039;s request, and the calculation has come back at an amount that will leave us unable to pay our basic bills. I am desperately looking for any advice on how we can get them to listen to us.&#60;br /&#62;
He already paid her a large settlement on seperation and has spent 5 years clearing her debts through an IVA she ended up with. About 4 months ago, she suddenly stopped him seeing the kids, changed all their phone numbers, moved and refused to give any contact info and then suddenly filed a claim with the CSA.&#60;br /&#62;
We have my 4 children living at home, their dad is assessed under the Old rules (so I am told although I am unsure to why) and seems to have a lot lower an assesment for his 4 children than we have been given for my partners 3. Does anyone have any advice? The only other option my partner feels he has is to either resign or move out :(

<description>&#60;p&#62;The CSA will only start taking maintenance into account from when the request for maintenance comes in from the PWC.&#60;br /&#62;
If your partners ex then asks for payments direct to her ignore it and insist you pay through the CSA unless she is willing to sign a private agreement document (downloadable from the CSA website) and that the CSA have, in writing, acknowledged this. Even then, make sure all payments are made through a bank and it is clearly stated as child maintenance.&#60;/p&#62;
&#60;p&#62;My ex made the accusation I had not been paying her and it took me an age to prove to the CSA that I had been and even then the CSA would not back down until my ex finally admitted she hadn&#38;#039;t been truthful.&#60;br /&#62;
With the CSA, if you are a PWC, then you are deemed to always be in the right even if facts prove otherwise. This is one of the many reasons the CSA is unfit for purpose.&#60;/p&#62;
&#60;p&#62;If she takes your partner to the CSA now then you will be under the new rules and your income is seperate from their assesment.

<description>&#60;p&#62;Hi there.  Bit of a strange one....  Any comments below are puely in relation to my ex and our very unique circumstances....&#60;br /&#62;
When I divorced from my ex in 2005, we came to a private arangement regarding maintenance for our daughter.  I would pay the rate as per CSA calculations until daughter was 16.  At this time, payments would cease regardless of her educational committments.  This was in exchange for and extra £37,500 in the settlement than me, for her to use accordingly bearing our agreement in mind.&#60;br /&#62;
This would mean ex was always a winner as CSA only worth £11,500 to her from daughter being 16-19years.&#60;br /&#62;
The agreement was signed by her and I paid on time every month.&#60;br /&#62;
Daughter turned 16 last August and ex initially tried to claim from her recent ex but he told CSA where to go.  She has now claimed against me and CSA have said I have to pay.&#60;br /&#62;
We are going to tribunal in a few days and she is being very slanderous (which I hope does her no good).&#60;br /&#62;
I have sought legal advice and they have said if I lose at tribunal I can try small claims court for half of the £37,500 back.&#60;br /&#62;
I feel very annoyed that the agreement between ex and I can be quashed by CSA as this will now affect my life and that of my young children with my new partner.&#60;br /&#62;
Does anyone have any tips of what I can say at tribunal.  Up to now, I have told the plain truth and provided evidence to support every point I have made.  My ex&#38;#039;s recent ex has also given a copy of the letter the CSA sent him as he feels angry at what we believe is her greed.

<description>&#60;p&#62;It might because I&#38;#039;m the NRP but I found my local MP to be totally useless.  They were no help at when I had an issue with the CSA machine and the reply provided no helpful information and the extra information they included was just a reprint of a CSA press release about how great the new system would be.  &#60;/p&#62;
&#60;p&#62;What was my issue? I had been assessed under CSA1 but my ex had started a case for another child under CSA2.  She stopped the case and instead of continuing to transfer me to CSA2 they left me on CSA1.  Since then my ex re-opened her other case(s) and the CSA have been phasing my payments down from the CSA1 rate £61 to the CSA2 rate £35 - currently at £46 with 1 year of phasing to go.

<description>&#60;p&#62;Well, not to cause conflict guys, but I&#38;#039;m on the complete opposite end of the scale.  My daughters father does not/has not ever paid for her, even though CSA intervened as soon as I made a claim for income support nearly 15years ago.  Although I went (HAD) to go back to work when my daughter was 3months old and had to finish work the day before I had her, I have never received a penny from him and the CSA have not been any use.  The latest news (after mithering for years) is that he does not have to pay me anything, including arrears.  Despite the fact that him and his fiance have a nice house, 2 cars, good careers and copious amounts of holidays per year.  Fair enough, they have 3 children together (one of which is the same age as my daughter), but where is the justice for individual&#38;#039;s such as myself that have had to struggle for almost 15years whilst people like that can carry on with their life like nothing is wrong.  My opinion in regards to the way the CSA speak to absent fathers/mothers probably derives from the fact that ALOT of parents sherk their responsibilities and expect to go through life unscathed by their actions.

<description>&#60;p&#62;This is what happened with us, I&#38;#039;m the wife of an NRP. The CSA took our Tax Credits into account for my son and our son and gave it to my husbands child. We were left with nothing after paying loans I took out in my own name to help out his ex and their child keep a home after she ran up debts in his name and got his credit score blacklisted. After I ran out of money, she ran to the CSA and we nearly lost our home. &#60;/p&#62;
&#60;p&#62;The only way out for us was for me to work and my husband not to work and which we did, they used the tax credits as his income and calculated the usual way. Now I&#38;#039;m suffering with an illness and we&#38;#039;re on jobseekers but my husband cannot work due to us being left with nothing if he does work and myself unable to work (they messed up and stuck him on a DEO at 40% the last time he was working but now will not rectify the arrears we do not owe).&#60;/p&#62;

<description>&#60;p&#62;we are in a very similar situation and basically after 2003 nothing about your outgoings relates to the case - and beware we just got out calculations through and they even count child tax credits as an income - so tax credits will be included as earnings - your ex gets to keep all you pay as of 2010 even though she is on benefits which is terrible - if it is a new case u are on the &#38;quot;new&#38;quot; system so it is 15% of your net pay but don&#38;#039;t forget 20% is protected for the children at home and once the baby is born (congratulations) you can inform the csa and they will recalculate - if you have the children overnight, travel to see them and in doing so incur costs you can ask for a variation, I believe it to be a 7th for each night. It isn&#38;#039;t fair - it destroys families you can lobby your MP (thought mine seems to ignore me) contact the csa and legal advice but the csa do not involve themselves in circumstance or situations, though they have been amicable and at times helpful with us (depends who picks up) all they can do is take you income and work out payments - so for us the online calculator was about £4 under there outcome as you can not enter child tax credits into the online calculator - but I am going to look into this as I know I have seen somewhere that child tax credits are not an income to be assessed on. They can spread payments out though, on here I have seen people request that the csa pay the partners then the NRP pay back the csa - though it is not something I have done.

&#60;p&#62;I&#38;#039;m a Dad and have 3 Kids 1 with an ex partner and two with my current partner who lives with me, also We are expecting another baby soon.&#60;/p&#62;
&#60;p&#62;My Ex has contacted the CSA and now there asking me for my details etc...&#60;/p&#62;
&#60;p&#62;My worry is I earn around £1100 take home pay a month, with that there&#38;#039;s&#60;br /&#62;
Rent, Council tax, utility bills (Gas, Elec, Water, TV Licence etc)to pay&#60;br /&#62;
Which leave&#38;#039;s me with about £180 a month to pay for other things like Food Shopping mainly which if you take into account There&#38;#039;s two adults &#38;amp; two children under 4 and soon tobe a new born to take care of £180 over 4 and a bit weeks it&#38;#039;s very hard to feed a family of 4 on £40 - 45 a week when there&#38;#039;s Nappies, Baby Milk to buy etc....&#60;br /&#62;
It&#38;#039;s very tight and we don&#38;#039;t always get by....&#60;/p&#62;
&#60;p&#62;I have used the Calculator on the CSA website and they estimate me paying around £33 a week, If this is true this will leave my Family of 4 with £7 - £12 a week for food etc.&#60;/p&#62;
&#60;p&#62;Im at my witts end here is there anything i can do? Yes we claim Child Tax Credit &#38;amp; Working Tax Credit but that&#38;#039;s hardly anyhing a month it normally pays for the clothes on the kids back &#38;amp; mini treats for the kids - no more.&#60;/p&#62;
&#60;p&#62;The main issue is my ex partner doesn&#38;#039;t work and never has since she spilt from me she claims every benefit going she also has a new partner that earns enough to support them both as there always going away on holiday plus they run a decent enough car etc.&#60;/p&#62;
&#60;p&#62;Im really worried that I can&#38;#039;t afford to pay for the kids I have as it is without CSA taking more off me.... It&#38;#039;s so not fair that my Family will really suffer and my Ex get&#38;#039;s a £140 payout every month on top of the Benefit&#38;#039;s she already get&#38;#039;s plus her partners wage.&#60;/p&#62;

<description>&#60;p&#62;As far as i am aware they can backdate it but only to the date you first contacted them and opened a case - so if you opened a case 6 yrs ago they will back date it that far for example but if you contacted them last week and opened a case they will only back date it to last week - the whole system is a complete sham - in our case the mother gets more by banning us from the child we knew nothing about - but the csa do not get involved in anything except calculations BUT he will have to pay eventually his arrears from march

&#60;p&#62;A bit of background...i seperated from my ex hub 11 years ago &#38;amp; since then he hasnt given a penny towards our 2 kids upkeep.He does think however that hes done good by sending all of a school terms worth of uniform for them both over the 11 years (a wk or 2 before school started again &#38;amp; id already bought everything) &#38;amp; (through me practically begging) went half on 1 school camping trip for our daughter 3 years ago.&#60;br /&#62;
Finally in March this year the CSA got involved (due to personal circumstances they wouldnt before) Anyway my ex, who has a high position in a well known media company, has dragged this out ever since, putting in numerous variations &#38;amp; going through them to make payment for his other daughter (whom he was paying for through private agreement with his 2nd ex-wife, but the csa wouldnt take this into account when calculating the amount i was due) to get my payments reduced, so there have been massive delays. He has now moved another girlfriend into his place with her 3 kids, so the CSA have yet again reduced my payments,of which im still waiting to receive the first installment. This reduction i dont think is fair given the fact his new partner is working (&#38;amp; on a high wage) &#38;amp; already providing for her children, as she did before she moved in with him (and no i dont think her wages should be taking into account,but i certainly dont expect his wages to be reduced for calculation purposes because she has kids either).&#60;br /&#62;
He has bent over backwards now (&#38;amp; throughout the years) to weadle his way out of paying anything &#38;amp; it now looks set to be changed again because all of a sudden 2-3 wks after the csa got involved he asked our son to go live with him (although 2 months prior to this he didnt want to know when i suggested it).So again the amount will change which means more delays.&#60;br /&#62;
Anyway i asked the CSA about the arrears due &#38;amp; was told there will be alot of arrears incurred,but they only go from March when the case was opened &#38;amp; advised me to seek legal advise regards the previous years. So i called my solicitor &#38;amp; explained what the csa had said &#38;amp; that it was a new claim etc, he then stated that they cannot get involved with cases like this because the law says they cant, but that the CSA can go back 5 years! I then called the CSA back up again &#38;amp; relayed this to them but they are point blank denying it. Who&#38;#039;s right??or are they both just passing the buck?? = me very confused!!&#60;br /&#62;
Having read various posts on this site i see the mandatory time scale is 6 years that the CSA can back date arrears, some people even have the CSA after them for longer than that. But is that only for cases that were initially opened back then, under the old rules, or does it include new cases too? Can i press the CSA to do more or would i have to put in a complaint or even go direct through the courts,if possible??Am i just wasting my time &#38;amp; getting stressed out needlessly??&#60;br /&#62;
I think its unfair that my ex should get away with 11 years (through no fault of my own) of non payment, all the while pleading poverty. I just want something back to put aside for the kids for when theyre old enough ie Uni or a deposit on their first house/flat etc etc. I thought that he&#38;#039;d have had a bit more morals &#38;amp; back bone &#38;amp; have started paying for them along time ago (as he started to pay his 2nd ex wife straight away,so why not me?), but guess i was wrong. And yes he had been asked,numerous times, for assistance whether from myself or his kids, which always fell on deaf ears or came too late (ie the school uniforms came late, the camping trip money came a little over a week before our daughter was due to leave for it, making me stressed out incase i had to then try &#38;amp; find the remaining money so she could go!!the remaining times were ignored or excuses made for having no money, then he&#38;#039;d go on holiday abroad or buy a new car or the latest top of the range gadget!!).&#60;br /&#62;
It infuriates me that he&#38;#039;s now acting like the injured party &#38;amp; not owning up to his responsibilities. I know there are plenty of absent fathers out there who do provide for their kids &#38;amp; for that i admire you &#38;amp; wish you well with your fight against the CSA &#38;amp; their ridiculous practices &#38;amp; possibly vultures of an ex partner. I dont consider myself bitter &#38;amp; am definately not a vulture nor have i ever stopped contact with his kids, i just want what is rightfully due to his kids for their future, is that too much to ask??&#60;br /&#62;
Any advice would be greatly appreciated :)&#60;/p&#62;
&#60;p&#62;***before i get a backlash about his new partner &#38;amp; her wages lol let me explain further...i dont expect her wages to be taken into account (why would i want another woman to pay for my kids??) as i was advised by the CSA &#38;quot;why should she pay for someone elses children&#38;quot; &#38;amp; i totally agree but my point is if she shouldnt have to, then neither should he,but he is...hes paying for hers &#38;amp; they have reduced his wage accordingly which affects the amount i will receive for his own flesh &#38;amp; blood (ie they allow for other children living in the household regardless of whether the partner works or not). I think the rules should be that if the new partner is working &#38;amp; has his/her children living in the same household,then the NRP&#38;#039;s income should not be reduced for calculation purposes, as the new partner is already providing for his/her child(ren). If the new partner does not work &#38;amp; theyre child(ren) are living in the same household THEN the NRP&#38;#039;s wages should be reduced accordingly after other factors are taken into account ie does the partner have income from other sources such as rental from a property or maintenance payments for the said child(ren) etc, the latter being payments for the day to day care of the child(ren) anyway...I dont think its fair the way they do it now,let alone how they did it before...thats my views anyway. Between my ex-hub &#38;amp; his new partner they have a weekly income coming in that equates to more than what i have in a month &#38;amp; yet my ex-hub is the one complaining about not being able to afford to pay &#38;amp; doing all he can to get payments reduce (i have the intimidating &#38;amp; somewhat smug emails to prove this) all the while living the life of luxury!!hence why i do not think the new rule is fair. If they abolished the partners wages being taken into account under the new rule,they should have abolished taking into consideration the new partner having his/her child(ren) living in the same house hold aswell, moreso if the new partner works or has income from other sources coming in. If they were working to provide for their child(ren) before moving in with the NRP and are still working then why should it change the NRP&#38;#039;s wage??***

&#60;p&#62;I broke up with my ex about thirteen years ago after a brief two year relationship. She’d come to the UK from abroad on a two week holiday so she could be with her family as they’d all moved back from abroad. My ex and her child were the only two in her family that wasn’t allowed into the UK to live full time because they weren’t British citizens. Her mum and dad moved abroad in the late 60’s with a child, so they all had passports.&#60;/p&#62;
&#60;p&#62;While they were abroad they had two other kids, my ex, and her brother.  He got his passport as a duel national because of his job in the UK. My Ex and her child didn’t have a passport so when her family moved back; she had to come in under the radar, under the pretence of a two week holiday with a return ticket, and only carrying the stuff that made it “look like a holiday” with her kid. &#60;/p&#62;
&#60;p&#62;When she came on her “holiday” I didn’t know the full story because I hadn’t met her at the time.  I did know her brother from the place I worked. When he introduced us we hit it off and, it was only then I found out about the “holiday” thing. At that point she had rented a flat and was getting benefits. Surly that must be fraudulently claiming benefits? Cutting a long story short, I was stitched up, she fell pregnant with my child then we had a quick registry office job, and, that’s when the shit started.  Within a few months she was having an affair, starting fights with me, hoping I would bite and she would have a reason to kick me out and, apply for a divorce saying it was my fault! Oh yes, she was a real class act!! &#60;/p&#62;
&#60;p&#62;Some of the things she said and did were really nasty and I was hurt loads, so in the end when she said she would take my kid to abroad if I didn’t go, I called it a day and left. She was always being a bitch from that point, making my life hard work but she did say she wasn’t after my money so I told her, “good, you’re NOT getting any, EVER” &#60;/p&#62;
&#60;p&#62;After she split up with the affair guy, he paid for her driving license!! She moved about 200 miles away from me when my little one was six years old to make it really difficult for me to see her.  She put in another fraudulent claim which I’m sure must be the case because she’s NOT a British Citizen, she came in illegally. Some time after that she got in with a guy that was doing really well for himself and ended up with her master plan. She had it ALL, a big house in a posh road with a 4x4 and all the nice toys, everything.&#60;/p&#62;
&#60;p&#62;I was in and out of low paid work, on benefits and/or studying with the Open University for a few years. I found out she split up with the money guy for a while and she put in another claim. At this point I was contacted by the CSA and because I wasn’t working the amount was £0.00. I remember thinking good, you’re not getting anything anyhow!  I got my old job back and another three years past and I didn’t hear a thing form the CSA until I moved jobs in 2009. That’s when the shit really hit the fan. I’d been working in my new job for 12 weeks and I got a letter from the CSA saying, they had put and attachment on my wages for £220 per week, I only got £210 per week so, I don’t see how that works! AND I got a bill for £14,003 &#60;/p&#62;
&#60;p&#62;At that point I just called it a day with the job that I loved and quit at the end of the shift. I started looking for something that paid more money, it didn’t happen, and in September of 09 I was forced into bankruptcy. I’m now unemployed, not getting any benefits and being financed by my family at the age of 46&#60;/p&#62;
&#60;p&#62;I’ve been discharged for about 9 months now, about three weeks ago I got another letter saying that they wanted £24.500 within the next 14 days or, they’re sending the bailiffs round. I sent a letter saying you can’t do that because it’s not my house, I sold all my assets fighting off bankruptcy, i’m unemployed, not getting any benefits so I made an offer of £1 per week and said, I’d be in contact when I find employment or, become self employed.&#60;/p&#62;
&#60;p&#62;She had two more kids with the guy that was doing well for himself and then, he died, so I figured her master plan had played out well. She goes through life just taking what she can get and moving on. I bet all her dreams come true when he died!! &#60;/p&#62;
&#60;p&#62;Don’t get me wrong guys I’m all for supporting my child and I will but, I will give the CASH to her. I will always help BOTH when I only need to help ONE but, I won’t help my ex in her quest of men being cash cows!&#60;/p&#62;
&#60;p&#62;On the rare occasions that I do see her which is about 5 days a year, some years I don’t see her at all because she lives 100s of miles away. If i don’t have contact with her i don’t see how this is fair, I’m being punished. The way I see it is, she’s the one that has done wrong, not me! I’m really P***ed off with it now and I want my life back so I can earn some cash and help my girl out because, she wants a car in a couple years and that’s going to cost me!&#60;/p&#62;
&#60;p&#62;Now I have two questions&#60;/p&#62;
&#60;p&#62;(1) Can a person that is NOT a British Citizen who came in to the UK illegally really have any claim over me with the CSA? &#60;/p&#62;
&#60;p&#62;(2) Are the benefits she was claiming fraudulent because of her illegal entry into the uk?&#60;/p&#62;
&#60;p&#62;After hearing our prime minister on TV lately saying “people like me are no better then drink drivers and should be stigmatized” I’m at the point now that I’m going to fight this rubbish and inform the UK border agency, report the benefit cheat and, tell the CSA the same. I’m sick of her thieving crap.&#60;/p&#62;
&#60;p&#62;Any suggestions? I would really appreciate it!! The only reason I’ve not done this before is the risk of my child siding with her mum but, I see no way out now. I can’t get a bank account or a job because they will just take/steal my money, stopping me from having a life while her master plan is at end game, well, until she finds another target!&#60;/p&#62;

Ask for a variation.&#60;br /&#62;
Personally for me i didn&#38;#039;t get any reduction as i couldn&#38;#039;t provide receipts for the full amount, despite the fact i had court papers detailing financial settlement. So don&#38;#039;t hold your breath on that. And the csa don&#38;#039;t take anything into account when working out your payments, basically they don&#38;#039;t care what your out goings are. Csa maintenance is a priority debt so it superseeds all your other commitments.&#60;br /&#62;
If you have your daughter more than 52 nights a year you will get some reduction for that.&#60;br /&#62;
Its a ridgid system and they are unfeeling don&#38;#039;t expect any sympathy.&#60;br /&#62;

I&#38;#039;m currently paying my mortgage, IVA, debts(occured whilst we were a family) and on top of this gave her £52,500K less than 3 years ago. I have done the calculator on csa site but I will not be able to make those payments whilst paying all the other debt off and keeping a roof over my head and my daughters when I have her. Does anyone know what the CSA will take into account to make the payments smaller... any advice on this will be a godsend&#60;/p&#62;
