I had an attachment of earnings for many, many years but have been ORDERED (bullied into) to pay £22:00 per week for the next 104 weeks. I begged the question as to how I have such arrears &amp; was fobbed off with aggressive intimidating responses &amp; told in no uncertain terms that if I did not agree to pay the arrears back at these rates, I would be forced to pay the arrears back at £101:50 per week until 04/2012. I even went to the appeals court in Leicester many years ago to contest arrears at the beginning of the order &amp; WON my case to have a deferment of arrears issued but this has not been recognised. I have therefore began to re-pay £2288 to THE SECRETARY OF STATE that I can ill afford to pay as it is! They were no help at when I had an issue with the CSA machine and the reply provided no helpful information and the extra information they included was just a reprint of a CSA press release about how great the new system would be. </p> <p>What was my issue? I had been assessed under CSA1 but my ex had started a case for another child under CSA2. She stopped the case and instead of continuing to transfer me to CSA2 they left me on CSA1. My daughters father does not/has not ever paid for her, even though CSA intervened as soon as I made a claim for income support nearly 15years ago. Although I went (HAD) to go back to work when my daughter was 3months old and had to finish work the day before I had her, I have never received a penny from him and the CSA have not been any use. The latest news (after mithering for years) is that he does not have to pay me anything, including arrears. Despite the fact that him and his fiance have a nice house, 2 cars, good careers and copious amounts of holidays per year. Fair enough, they have 3 children together (one of which is the same age as my daughter), but where is the justice for individual&#039;s such as myself that have had to struggle for almost 15years whilst people like that can carry on with their life like nothing is wrong. Despite paying since day 1 and supplying all the information they request when they request it. This time they "miss calculated" last years assessment. So here i am with a debt i didn't incur and they want it back in 12months. This means my payments jump £250 per month. It also appears i was re assessed this year on last years wage slips.<br /> I feel they have yet again failed to follow procedeure. My basic payments have gone up £100 per month as well.<br /> What is really urking me is in the last 12 months i have had 2 investigations 1 complaint and now this. Obviously my ex requests re assessments regularly. I would really like them to leave me alone. I find my resolve starting to crumble. If she wants more money why can't she go out and get a job??<br /> There are about 950,000 of us having money stolen from us every month and we don't have a voice. What would happen if those of us who are stolen from by standing order cancelled that order the day before collection then re-instated a few days later??<br /> As of this moment in time i'm screwed but have a plan. It will take a little while to do but will reduce my payments to the minimum. I have no qualms about that as in the last 4 years i have paid £20000 in maintenance and she took all in the divorce and i mean all.<br /> I live in a bedsit sleeping on a settee and have limited access to my kids as she moved away to be with her new husband. I have no car and can't afford train fares often. Initially, you'd be better asking this person to contact you in writing. Also ask their name and the team they work on. This will enable the person to be identified and you can also complain about the bad attitude.</p> <p>If it is a genuine call, then what happens will depend on when the case started. If it's before March 2003, it will be old rules and your income can be taken into account. If it is after that date then it is a new rules case and your income cannot be included in the assessment.</p> <p>However, your child tax credits can be included, but only if the parent with care asks for this or you husband volunteers the information.</p> <p>If the child has been adopted (and I'd expect your husband to have received court papers if it had) then his liability would cease at the The csa are uncaring if thye leave you homeless starving and kids on the street! They almost brought my hubby and me to seperate as we couldnt afford the figure they wanted with the arrears that appeared!! My hubby was clinically depressed from 2000 to 2005 he was in no state to talkk to csa or anyone for much of this time and was signed off so not paying csa and his ex opted in and out. They found arrears from this period recently so we owe £2500 now. when we wrote and explained and gave his p45s to them as proof of not working they didnt want to know as he had not contacted them saying he was off sick!!! We tried everything to help our selves but to no avail. My advice would be to go to citizens advice and maybe call one of the csa lawyer specialists for a free consult and gather all advice and then through it at them. I was made Redundant in February 2010 and was unemployed until August 2010. I had stopped my £182pm CSA payments between these dates as obviously i had no income except job seekers allowance. I had no contact whatsoever with the daughter in this time and until now have had no contact despite numerous attempts to see her. </p> <p> After being re-employed as i was not seeing my daughter and seen no light on the horizon that i would see her any time soon i did not contact the CSA as to me being re-employed. They contacted me again on the 15th November asking for wages slips as this is when the mother called for the case to be re-assessed. I sent them wage slips with two average monthly wages (around £1350) this included overtime and bonuses. I then received a letter telling me i would have to pay £46 per week from the 15 Nov 2010. It was now 25th January. This was fine as this was roughly what i was paying before i was made redundant.</p> <p>I then received a letter on the 15th February telling me i was £2712 in arrears and i was to call them immediately (which i did) i did not agree at all with the arrears amount as i was unemployed from the February to the August and as far as i am aware they cant claim arrears from before the mother asks for the case to be re-assessed (WHICH WAS 15TH NOV 2010).</p> <p>I have now received a letter on the 3rd April demanding a one off payment of £456.06 payment to be paid by the 4th April then my regular monthly amount of £196.54 and on top of this i have also to pay £226.00 totalling £422.54 per month. </p> <p>So.....my question is am i correct in thinking that my arrears should only be calculated from the 15th November 2010 till now (APRIL 2011) as this is what i was told by one of the CSA agents when i called them after receiving the first letter from the CSA. Also is there no way no negotiate with how much you pay back your arrears. Paying this amount per month will leave me homeless and penniless. You need to be quoting your previous letters to them and enclosing copies (you will have to refer to your phone calls) and ask for a complete break down of your account with them. Enclose a copy of their letter saying their are no arrears and give them fourteen days to provide the complete break down or you will refer the matter for Judicial Review.</p> <p>Also write to the CSA in Longbenton asking for a complete copy of your file, including all computer and clerical records, under the Data Protection Act, enclose a postal order for £10. They will send you a complete copy of your file but it will take about a month to come. Also ask for the computer log to be properly dated.</p> <p>That gets you started.
