This is really strange. I have just received a letter from the CSA, stating that I have been put forward as the father of a child, born last year. It is ludicrous for me I have not slept with any woman for more than 5 years, and I have never so much as been on a date with the mother.

It actually took me some time to work out who it was. Essentially I started a new job a few years back, and I was almost immediately pounced upon by the office gossip girl. I straight away took a dislike to her, and I am never keen on sharing my private life with people I don't know, especially when it was obvious to me that I would be the topic of conversation for all her. I was not rude but she asked me if I had a wife or girlfriend and I joked "This feels like an interrogation" and when she did not back off, I told her straight that I did not want to talk about my private life.

She left the company 12 months or so later after not having anything particularly to do with me, except maybe putting 3 or 4 letters on my desk: that is the totality of our 'relationship'.

So:
a) as is is totally impossible for me to have fathered a child with this woman why should I be forced to give personal details to the CSA? Am I obliged to share anything with them at all. (I will obviously tell them the story of mine and her 'relationship')
b) If I am forced to give my details will she get to see them? (This could be why she is doing this, to be nosey about my personal life...I cannot imagine why else)
c) I have been reading about DNA tests and the like...surely I should not be in the position to have to front money and waste my time to do this? Like I said, I have exchanged about 20 - 30 words with this woman and never seen her outside of work.
d) Do the CSA use a withheld telephone number, I have a considerable number of missed called from both withheld and 0845 numbers. If yes, please tell me I can make them stop.

My partner pays CSA. Does the fact that I'm a full-time student affect this, ie am i classed as a dependent? And would this have an effect on his payments?
Thanks!

Hi there,

My son was born in 1991, and me and my partner split up shortly after. The CSA contacted me and between 1991 and 2001 I paid various amounts from £70.00 - £95.00 per week through an attachment to earnings order, even though I was paying regulary in the first instance. I was a postman at the time, so the only way I could cover these kind of payments was through overtime. My mother then became ill and I took four months off work unpaid to look after her. I also lost my London flat in 2001 after getting behind on my morgatge payments and moved jobs later that year. I admit my mistake in not informing the CSA of moving jobs, but it was an extremely stressful time. The CSA then got back in contact with me in 2003 and advised that my new payment would be £35 per month. (greatly reduced due to my greatly reduced wage). This was paid until 2008. I then received a letter from IQOR debt collectors for the £7000 arrears I had supposedly amounted. I did not question this at the time and it was arranged that I would pay £5 per week via standing order of which I never missed a payment. IQOR had been in contact at various points over the last few years, but in November last year they advised that they were going for an attachment to earnings and I upped my weekly payments to £10 per week. They have now sent a request to my employer for £110.00 per month which is quite a big leap and will place me in financial trouble. The CSA advised me today that the £7000 arrears are made up of a sum £87.50 per week for the 22 months (roughly) that I did not inform them of my new job which was alot lower wage then when I was with Royal Mail. I suppose my question is, can I appeal against these arrears? Can IQOR enforce an attachment to earnings, and if so why have they took five years to apply for one? Thank you for any advice.

My partner of 4 years has 4 children to a previous partner. We have no children as we cant afford them. His kids stay with us every weekend in our 1 bedroom council flat. Currently my partner has a wages arrestment order which gives 60% of his wage to his ex, He is left with £500 +/- per month. I am currently off work on Statutory Sick Pay (£86 per week)and have been off for 3months. We have been declined for housing benefit and any other benefits as my partners income before deductions is too high. We are really struggling to pay rent and are currently over £1000 in debt. I understand that my partner should provide for his children but the financial situation doesn't quite make sense to me. Could anyone give me any advice?

The csa are basing my payment amount on 3 wages slips, which are three slips in december and as a pstman these three slips are probably my three biggest pay weeks, and as such are demanding 400 a month from me,for my three kids,i was previously paying 315 a month,is there any grounds for appeal and that they could judge my payments ona greater number of weeks? many thanks

Guys,

Looking for your advice if I can.

I was contacted by the CSA last May after an ex said I was the father of her 4 year old son. I’ll not go into too much detail but during the brief time we were together she lied about everything other than her name and was sleeping with at least one other person, however I suspect there to have been more.

I have no idea where she now is however I know that she is married and has another child. Things that in life I’d have loved but now have an issue with relationships after what she did to me. Anyway my sob story aside the CSA basically caught me off guard last time around, phoning me on a Saturday morning totally out of the blue.

There being no way out at the time I paid for and had the DNA test and waited for her and her son to take theirs. Four weeks later and not hearing anything from the CSA I contacted them who in turn contacted the mother. That evening I got a withheld call from her saying she wasn’t prepared to take the test and as a result the CSA dropped the claim.

Something told me in the back of my mind that she’d make an attempt in the future and on Friday got a call from the same free phone CSA number. This time I did not answer and blacklisted the number on my phone so when they call it just hangs up on them immediately.

My question is this, how long can I get away with avoiding them before I’m pushed into taking the DNA test again. They’re bound to call me on my home number but I let these calls divert to my mobile and always let these calls go over to my voicemail.

I almost feel that this is some sort of game and this time I’m going to play it to the best of my abilities, however some worldly advice would be very much appreciated. I’m sure after the calls the letters are bound to follow, is this basically the end of the line when this happens or do they need absolute proof that I have received them (i.e. a signature)?

Finally I’ve read loads on this site (which has been amazingly helpful and comforting in many ways) with regards to self employed people. I’m a sole trading tradesman, can any of you give me some advice as to what I should be doing right here and now (before the CSA do get me). I’ve heard about going limited and only paying yourself a pittance with dividends making up the lion’s share, can anyone provide more detailed assistance??

All my thanks in advance,

M

Hi Guys I wonder if you would be so kind to help me, as I am very confused about the CSA.

OK I have just received a claim from the ex wife for my 2 children, very happy to pay just don't understand how to make the calculations, below I have listed my current income etc, I have re-married and have a new born child with my new wife.

Ok so need to pay via CSA for 2 Children
I don't have access to the children
I work part time and have an income after tax etc of £150 per week
I have a small company running at a loss about £20K, for last 2 years, no income taken from that.(i am told CSA dont look at losses from self employment?)
I get working tax credits every 4 weeks £550
I get new child tax credit every 4 weeks £250 ( will they take from my new child i hope not)
I have a medical condition and get disability element of the working tax credit, built into the amount award.
I also receive industrial injuries Disablement benefit, for life award about £120 per month, I did read that I would pay £5 a week with this benefit is that extra or total??

would I be right in thinking that I will need to find about £50 a week from now? Thanks for the help guys, its a big help when on a low income.

Hi, my partners ex took him to the child support agency 5 years ago and he asked for a DNA test the mother refused this and we recieved a letter from the csa saying maintenance had been cancelled a his wasnt the childs father. Now 5 years on we have received a csa letter for maintenance for this child the mother has agreed to do the dna this time and we have found out the child is my partners. But will the csa be able to backdate this claim for the past 5 years? and now we have dna proof does this entitle my partner to be on the childs birth certificate? please advice as this is causing us lots of worry and sleepless nights

Myself and my wife divorced a couple of years ago. I won't go into the details surrounding our relationship or decisions..but but we went from a personal arrangement on child support payments to it being done through CSA.

She is looking to move away and it's looking likely I will be moving overseas soon. We have looked into her being able to remove parental responsibility on our child from me but that appears impossible.
My question is..is there any way she can contact CSA to request that I no longer have to make any payments on our child as we are both looking at making fresh starts in our lives.

Hello all, hope you can give me some advice. Back in 1992 I was living in Hong Kong and got married. It didn't last and we separated after 3 years or so. Unknown to me she was pregnant at the time we split. Anyhow I went my way and she went hers. I returned to the UK, in 2000, and heard that she was living in Australia and had a son. About 3 years ago CSA Australia contacted me saying that I have to pay. I explained to them that I have never had any contact with my ex and that she didn't want me to have contact with her so why should I pay. I dug in my heels and stuck my head in the sand, not the best approach I know. Last week a summons arrived on the doorstep demanding payment of arrears. Can I be forced to pay CSA Aust. Im not Australian and she isnt British.Any advice would be much appreciated. Thanks

Hi All,
I hope someone can offer some advice. My ex-wife and I have been separated for about 4yrs. I have an 8yr old daughter and we split the care with me having her 3 days a week and my Ex having her 4 days. When we separated, my solicitor worked out my maintenance payment based on my salary and the fact that I only had to pay for the 1 day each week that my Ex had my daughter extra. However, my Ex claims Child Benefit, Tax Credits and Housing benefit for all 7 days. I have contacted citizens advice and they have siad that the only way I would be entitled to any of that benefit would be if my Ex was to offer it to me. Now, obviously, this isn't going to happen.
I was wondering if I went to the CSA, whether they would take into account the fact that I have my daughter 3 out of 7 days but don't see any of the government benefits when my maintenance payments are calculated.
Any advice will be most appreciated.
Thanks

Hi

I am self-employed and the CSA work out my payments from my most recent tax return (on the new system) therefore the amount I am paying this year will be based on how much I earned last year. My question is when I submit my next tax return and my actual income for this year is set in stone, will that mean I will be in 12 months worth of arrears (or credit) if it differs from how much i earned according the previous tax return, or will the amount I have to pay simply change from the date the CSA find out i.e in April.

I am by no means intent on avoiding paying - I just need to know if I need to keep constant tabs on my income throughout the year in respect of the CSA.

Many thanks

I would love some info on my situation. I have one child who has Down's Syndrome, I receive carers allowance and she dla care and motability component ... I am unable to work as her care is full time, our rent is paid also. Her father pays £20 pw, he does not see her or have any contact with her or me, He has his own catering business. ok my question is would it be worth my while contacting csa ? would we lose any money from what we receive ? should we be getting more help from her father ? ..... thank you.
I have never asked him for anything for 11 years, the £20 we receive was his decision.

However due to arrears the CSA have a detachment of earnings order, originally for Approx £550. Because she felt that she was unable to meet this amount, due to a short term difficulty. She contacted the CSA by telephone and agreed on a new figure of £350 until the difficulty had passed, with a view to increasing asap. However the amount actually taken from her wages was £750.Again she telephoned the CSA . The !st person to speak to her confimed the £350 agreement was on the screen and was putthrough to someone else to sort it out . The very arrogant chap lust repeatedly told her that due to the arrears the were , by law , allowed to take 35% of her net income. This however only leaves her £220 per week to pay all her bills etc , and run her car of which she needs for work, and it doesn't take into account that petrol costs for work alone are £120 for a 4 week period . She is beside herself with worry and feels that she will eventually lose her job as she will not be able to afford to get there or that other bills will go unpaid until the bailiffs come and take all her belongings etc etc . she wants to pay back the atrears but feels that she is being put in an impossible situation . What should ahe do ? Regards D Sheppard .

Hi,

Until a few months ago, my children were sharing their time roughly 50/50 between the two homes. Now, one lives with their mother full-time and the other lives with me full-time. Neither spends any time with the other parent.

Though this is a situation that I am desperate to resolve for the sake of our family and children, I also have to deal with the immediate financial aspects.

The mother continues to claim child benefit for the child that lives with me and I also pay CSA payments to the mother for the child that lives with her.
So the mother now gets child benefit for 2 children and a payment from me for 1.

But the CSA assessment takes no account of the fact that I have a child with me.

I basically get nothing for the child with me - no child benefit, no reduction in CSA payments and nothing back from their mother who works full-time.

So basically, the CSA appear to be biased toward the mother. I have to pay her for the one child with her, while she also gets child benefit for both, but the CSA are treating my son and I as if we do not exist.

I have submitted a claim, but they say it will take up to 12 weeks. Why did the mother's claim get settled within 2 weeks while mine will take 12?

After a bit of advice please.

I informed the CSA in beginning of September that my earning would change and gave them a rough outline of what my new taxable income would be starting from the end of September. I furnished them with P45 and pension information which would mean a reassessment of payments to £140pcm from £460pcm.

I have maintained payments for 01 Oct, 01 Nov and 01 Dec on the current £460 knowing that they would owe me monies. They have now informed me that the new maintenance payment will commence on the 01 Feb 12, with them owing me approximately £960. The kick in the N**s is that the money they will pay back to me will be dependent on how my Ex wants to take and can be up to 2 years.

I was told initially that any overpayments would be paid back into my account, how gullible was I. Knowing my Ex she will want to delay things as much as possible so will spin some yarn in order to get a 2 year pay back period. She is a full time probation officer, earns a good salary and is in receipt of other benefits such as carers component of DLA for my Son who is 14. She is not skint and brings in more than me.

My question is what is the best way to approach this and would I be within my rights to stop all payments until the overpayment ammount has been cleared. I know this latter action would have no impact on the welfare of my Son.

All advice appreciated as at the moment I am feeling somewhat despondent with this awful system and regime that favours the 'parent with care'

My husband left our family home to go live with another woman back in January 2010. He was originally to pay me maintenance directly each month, starting at £150. The next month it was £100. Then it was £90, £75, £50 and ended up at him saying he couldn't afford to pay more than £20 a month any more, despite having just paid out over £1000 on a fortnight holiday during July. It got to the point of me calling CSA just so I could make sure I got regular payments and he couldn't go back and forth on what he felt he could afford. CSA took until the end of November 2010 to decide how much he should be paying (which was £90 a month) and set up the DD via them. I got my first payment in the middle of December. Then low and behold Ex Husband managed to get fired from his job of 5 years. I had no help at all financially between July and December 2010, then again from January 2011. He never helps pay towards new school clothes, nor towards any extra school trips etc that may crop up. He barely sees her, yet claims it's my fault and is extremely petty. I found out at the end of August (11) that he had been working again since the start of July (11) and called CSA to make sure they knew, which they hadn't. They started working out the new payments he is to make etc, but since then I've been a bit stonewalled. Normally it will take up to 3 months to sort out, but I am still waiting. At first they had to wait for employer details to filter through, then it was that they needed to wait for the team to get round to working it out, then it was that they had problems with the employer details and had to wait for them coming through again. When I called several weeks ago I was told the case was just about sorted out and wouldn't take more than a couple of weeks to finalise and I'd be informed of details. I called again today to find out where everything is at and was kept on hold for nearly 15 minutes before the man I spoke to finally came back and said there was a 'technical issue' on my claim and the tech team were going to sort it out as the software needs to be checked over. He also said I could be in for a very long wait and there's nothing he could do about it. I feel extremely annoyed and fobbed off. You can find out how much is meant to be paid faster just by putting your details in the CSA website! I've been waiting 4 months and the case is still no nearer to being sorted out. All I want to know is how much is due and when to expect it coming each month so that I can manage the rest of my money around it and make sure some of it is set aside each month for my daughters rainy day fund (and not have to go without food treats myself every single week just so I can make sure there's always enough money there to provide anything my daughter needs), but I seriously feel mucked around here. I've had a grand total of £92 from her father in 16 months and my patience is wearing very thin!

Does anyone know anything about this 'technical issue'? Or have any advice about what to do? My ex is the kind of petty man that would refuse to give me a slice of bread if I was dying of starvation so there's no chance of him paying me a little bit each month while it's still being sorted out. I have no idea what to do =/

My husband stopped paying when his son left school at 16,only to be told some months later he was at college for TWO days a week which apparently means he has to pay again. He disputed this as the boy keeps getting disciplined apparently and we're sure he rarely attends (he's always in trouble)and may even have quit.

Also, my husband wavered his share of the sold house proceeds and over the many years has never missed a payment. He has done everything right, payed for many holidays, expensive gifts, lots of extra essentials, visited regular as clockwork. BTW, I've never interfered, until NOW!

She has gone behind our back to CSA (boy is now 17) and told them my husbands work place and he has been deducted over £600 this month with another minimum £600 next month to go as well straight from wages!!!

This is theft surely? The CSA only ever made one phone call and that could have been her or her friends. No letters! Nothing! The ex is abit of a crook, apparently the CSA just take her word for everything with no investigations.

How can we find out if he's even at college, or where? How can we find out if she's receiving child benefit, I believe you must be in receipt of this to qualify for child maintenance??

thanks for any response, my kids and grand child will suffer this Christmas while she has most of our money. This is making me ill!

Hi

Me and my ex split a year ago on bad terms (she went on dates with other guys when I was off from work whilst I was still living there but looking for my own place) but over the months things got better and we started to talk and I ended up seeing my son on a regular basis and also had him over to stay (as I ended up moving closing to him so I could be near him and work), however at Easter we had a huge argument and she then stopped me from having him over and seeing him, so now the only way I get to see him is once a week when my mam has him over. Currently I am going through solicitors to get more access to him and to see him like I did but things are moving slowly with that.

When me and my ex split up we agreed that as long as she can work her second job and I have him over then she wouldn't involve the CSA but after I lost access to see my son (no court order she just refuses this out right) she kept on with her second job but still wouldn't allow me to see him or having him over, as mentioned that I am going through solicitors to get access for my son but she has now contacted the CSA about back payments from last year and now wants me to pay whilst I still don’t even get to see him.

Currently I'm staying with my mam and paying her £250 a month whist trying to save up for my own place again but whilst I only earn an average of £950 a month, when I lived out Rent and all bills (inc credit cards) came to £850 leaving me with £100 for food, shopping, emergency cash,

I love my son very much, I cherish the little time we spend together and would do anything for him but I feel that now I cant buy him the things he would like and he's going to judge me on that, I just don’t know what to do. As if I do get access back to have him over and to see him, I wont be able to support him when he's over never mind supporting myself each much :(, this is also effecting my personal life as I wont be able to start a relationship with someone else as well

My partner is paying for a child, and every week his deductions are taken from his gross earnings but they take it all and leave him with £2. The CSA say that he owes "hundreds" in arrears. The employer says there is nothing that they can do becasue the CSA demand that they make the deduction. Isn't he legally supposed to be left with £270 to live on? Is this an error of the CSA or is it the fault of the Employer who makes the calculation of payments? Thank you in advance for any advice! :)

Hi all

first of all - as a new member it really hits home the dire situation we can be put in - all parties - by a system that seems pretty flawed top to bottom. shocking, really shocking.

Anyway - I'm just over one year in to my dealings with the CSA. I'm in employment, always have been, but got a lot of debt, mostly from my time with the ex (funny how its now all in my name and my responsibility). In the last 12 months, I've changed jobs, moved house, had a baby - all of which has meant several lengthy phone calls with the CSA, recalculations etc. Due to my debts and my changing circumstances, I've been paying what I can, all the while knowing an arrears was building but, seeing as my daughter is not in any dire need, getting myself and my family sorted seemed like a priority (my ex just has our daughter, where as I have my new son, my partners daughter, and my daughter to think of).

Long story short - been told by the CSA that due to an answer phone msg that I didn't respond to last October (nearly a year ago, right at the start of this horrible journey) someone at the CSA ticked a box that said I should be paying through my work earnings (DOE). Due to all the changes in my life over the last year and the ineptitude of the CSA, no one seemed to mention it to me (no letter or anything). I've payed about 1500 over the 12 months via manual payments over the phone, accruing an arrears of 2400 - not shirking my responsibilities, just avoiding bankruptcy whilst I found stability.

Anyway, seems the CSA now have seen that in October somebody there wasn't happy with me not responding to an answer phone msg, ticked the "DOE" box, it cant be unticked apparently. Huge figures are being mentioned now (£600 a month out of my salary) which has my ex literally wetting herself with excitement - my daughter sees none of this, it means she doesn't have to work.

My question is - is there any reasonable appeal about the DOE?! - I'm a good dad, see my daughter as much as I can, have made fairly regular payments, I will pay probably more than I can realistically afford if left to my own devices, and will clear my arrears in good time, next 12 months easy - my CSA case worker seems reasonable enough but states that I am now part of a process (DOE) that cant be undone, and I'm now going to be losing enough of my salary to really put my family in hot water - bills wont get paid, and bankruptcy is looking like an inevitability sooner rather than later.

Surely someone in the CSA will/should realise that I'm trying, and succeeding, in paying my way, but just in my own way and in my own timeline - by forcing me into this DOE they will end up crippling my family and losing everything - including any money to my ex - if I have to declare bankruptcy and/or just quit work...

Or am I just being very naive?

Any advice or opinion on DOE orders would be very much appreciated!

Thanks for reading

Im not going to moan on about the decision made as its apparant the csa can take what they want but to make the payments i cannot afford to live.
As i have read on this forum many of you are, or have been in the same situation and have faced the fact you are going to lose your home and not be able to have the kids at weekends overnight and end up having to pay even more.
every penny i earn and more is accounted for on the "mutual agreement" that we had but the csa decision is that i have to pay an extra £400 per month.
its simply not there.
so my question is what do i do now?
who is out there to help me?
does anyone in power actually care that i will now be adding to the homeless problem?

any advice would be really helpful right now

I’m hoping someone here will be able to give me a little advice.

I have been given notice of being made redundant from the forces, and will leave in August next year.

My question is:

I will get a redundancy package of a fair amount of money which I hope to pay of the mortgage.
But will the CSA want to take 15% of it?

It is tax free compensation, so I,m sure it won’t show up on my P60, so I don’t think the CSA will even be aware of it?

I would like to use some of the money to learn new skills and find employment as soon as I can but find myself in limbo not knowing how this is going to pan out.

Any help would be gratefully received.

Thanks in advance
