<description>&#60;p&#62;The CSA make plenty of errors and have historically been slow in updating maintenance calculations. I don&#38;#039;t see why this can&#38;#039;t work both ways, in this case, in your favour.&#60;br /&#62;
Write in with copies of your P14 for the period in question, ask them to make a calculation based on your actual earnings and to run off an account statement so you can see what they have calculated for each period and the payments you have made.

&#60;p&#62;My son was born in 1991, and me and my partner split up shortly after. The CSA contacted me and between 1991 and 2001 I paid various amounts from £70.00 - £95.00 per week through an attachment to earnings order, even though I was paying regulary in the first instance. I was a postman at the time, so the only way I could cover these kind of payments was through overtime. My mother then became ill and I took four months off work unpaid to look after her. I also lost my London flat in 2001 after getting behind on my morgatge payments and moved jobs later that year. I admit my mistake in not informing the CSA of moving jobs, but it was an extremely stressful time. The CSA then got back in contact with me in 2003 and advised that my new payment would be £35 per month. (greatly reduced due to my greatly reduced wage). This was paid until 2008. I then received a letter from IQOR debt collectors for the £7000 arrears I had supposedly amounted. I did not question this at the time and it was arranged that I would pay £5 per week via standing order of which I never missed a payment. IQOR had been in contact at various points over the last few years, but in November last year they advised that they were going for an attachment to earnings and I upped my weekly payments to £10 per week. They have now sent a request to my employer for £110.00 per month which is quite a big leap and will place me in financial trouble. The CSA advised me today that the £7000 arrears are made up of a sum £87.50 per week for the 22 months (roughly) that I did not inform them of my new job which was alot lower wage then when I was with Royal Mail. I suppose my question is, can I appeal against these arrears? Can IQOR enforce an attachment to earnings, and if so why have they took five years to apply for one? Thank you for any advice.

<description>&#60;p&#62;The CSA don&#38;#039;t give a monkey&#38;#039;s chuff whether the NRP has contact with the child. Maintenance is not tied to any access criteria. They are only interested in cash.&#60;br /&#62;
This is a familiar story, where the NRP attempts to follow the correct moral path,thinking the right thing is to seek access through the Courts, but is ultimately foiled by a devious mother who will not allow the father to meet the child by using a multitude of tricks. The NRP often spends tens of thousands to gain access and come the day, little Johnny is &#38;#039;ill&#38;#039;, &#38;#039;out playing&#38;#039;, etc.

If you want acopy of your file, you write to the Data Protection Unit and cough up £10 (I think)and it will take a couple of months.&#60;br /&#62;
CSL 105 and CSL 106 deal with the Appeals process.&#60;br /&#62;
You are wasting your time asking the CSA for &#38;#039;evidence&#38;#039;.&#60;br /&#62;
Lodge a Complaint with the CSA and when they haven&#38;#039;t answered you , after 8 weeks lodge a Complaint with the Independent case Examiner.&#60;br /&#62;
Look at the other thread - Incorrect Arrears and DEO - regarding action to take regarding the CSA and proof of delivery.

&#60;p&#62;My partner received a letter from the CSA after 15 years requesting maintenance of £39,500.&#60;/p&#62;
&#60;p&#62;The original question we have continously asked of the CSA is can they provide proof that my partner knew of the claim which has not been properly answered as they have only advised they sent mail which was returned as &#38;quot;dead mail&#38;quot; and that face to face officers could not trace him.&#60;/p&#62;
&#60;p&#62;We have now requested the file as they won&#38;#039;t provide the information we have previously asked and have requested all information that they hold but what will we actually receive?  Do they copy everything and send to us and if anyone has had to do this how long does it take, or is it a computerised spreadsheet of all info?&#60;/p&#62;
&#60;p&#62;Also we have received breakdown of maintenance due which is £10,000 wrong as they had him assessed as paying maintenance of £101 when he was unemployed for 100 weeks.  Do we appeal this just now?  I had prepared a letter stating on it &#38;quot;in no way is this an acknowledement of the debt until sufficient evidence is provided I was aware of the claim&#38;quot;.  Unfortunately there is time limits to appeal the amounts which exceed the length of time to get copy of the file as I understand it is 40 working days.&#60;/p&#62;

A full time student (over 12 hours of tuition per week ) pays nothing, but you&#38;#039;re not the NRP. Assuming you&#38;#039;re over 19, I think you would be treated as a non-earning partner which would not have a bearing on his assessment.

<description>&#60;p&#62;The CSA do allow for babies being born.  You must tell them as soon as a baby is actually born.  They will look as his net monthly or weekly amount and not use a percentage of it in their calculation.&#60;/p&#62;
&#60;p&#62;Based for example if he was earning £200 per week, according the way the CSA works is that if you do not have a child he would pay £30 per week, if you do he will pay £26.&#60;/p&#62;
&#60;p&#62;So technically his first child is worth £30 and your new one is worth £4.

She&#38;#039;s got an eratic temper and is always hostile towards me. A week on Saturday tippified the situation and illustrated just how far some women will go. I was accused of assaulting her when I wouldn&#38;#039;t hurt a fly and this all came about because she wouldn&#38;#039;t allow me to take photos and videos of my son which she has no right to do.&#60;/p&#62;

&#60;p&#62;Advise your brother to keep an account of everything that transpired as decent guys who actually want to be there for their kids don&#38;#039;t get too much protection. My ex has accused me of everthing under the sun and its slander. &#60;/p&#62;

She threatened and threatened for months on end to go to the CSA after he had been paying privately since the separation.  As soon as I came on the scene and we married she went for the juglar, trying to get her hands on my salary too.  As usual, she had just listened to her silly friends instead of actually finding out the facts.  Eventually, I got tired of the threats and contacted the CSA myself to find out the actual amount we should have paid, based on my husbands salary and the amount of time the children stayed with us - 2 nights a week at that point.  The short story is, the actual amount we should have been paying was £150 LESS than the amount we were paying her!&#60;/p&#62;
&#60;p&#62;In your case, your wifes two children live with you, so they would also be taken into consideration in the calculation.  Therefore, your payment would be:  Net income.  Less 20% for the two children living with you.  The figure you are left with would then be the figure used for the CSA calculation.  so, 15% for one child, 20% for two children.  Whatever figure you are left with then would also be subject to a reduction for any nights that your child/ren stay with you.  One night a week = a 1/7th reduction, 2 nights a week = 2/7ths and so on.&#60;/p&#62;
&#60;p&#62;As someone else has said, stop paying if you are contacted by the CSA, but do ensure the cash is put aside, as they will seek arrears.&#60;/p&#62;

&#60;p&#62;Any advice would be hugely beneficial I really don&#38;#039;t know what else to do. My little boy was born on the 6th September 2011 and he is 5 months old today. I have seen him 4 times all together as my ex has done everything she can to sever any contact between me and my child.&#60;/p&#62;
&#60;p&#62;I took my ex to court the minute I knew she was going to be difficult. I have done everything the right way but solicitors are now becoming too expensive and now paying CSA [which i don&#38;#039;t mind paying] is making me think I will have to give up.&#60;/p&#62;
&#60;p&#62;It&#38;#039;s not something I want and my ex has blocked my every attempt at seeing him and then lied in court saying she had given me numerous opportunities to do so. I have been accused of being an alcoholic when I&#38;#039;m not so I will be doing a Hair strand test to show I am not.  &#60;/p&#62;
&#60;p&#62;On the 9th Jan I was awarded parental responsibility and will be put on his birth certificate. I had to agree to 1 hour a weeks contact on a Saturday morning of which the order stated my ex not to be in the same room as me for that hour to avoid any confrontation. I am probably the most laid back guy there is but my ex has an eratic temper and can become incredibly hostile very very quickly.&#60;/p&#62;
&#60;p&#62;Contact started a few weeks ago and it seemed all the money i&#38;#039;d spent on court fees, solicitors was worth it until a week ago Saturday. I turned up for my hour at 9am went in everthing was fine my ex was upstairs I could hear her clumping around. I had my little boy in my arms and he was smiley and giggley at first. He started to get ancy as he was getting tired but i pacified him myself. After i settled him down i sat back down with him cradled in my arms and he fell asleep in my arms. It was the most amazing experience and I felt that maybe a bond was ever so slightly materialising.&#60;/p&#62;
&#60;p&#62;Once asleep my ex&#38;#039;s mother after going upstairs a number of times said we should put him in his rocker. I would have been happy to have held him for the remaining half an hour but he was basically taken off me. At this point I took a few pictures and a video and my ex&#38;#039;s mum demanded me to stop otherwise she would call my ex down. She came flying down the stairs and snatched my phone out of my hand. She went to walk upstairs and i followed her. About three steps up she turned around and basically ordered me to delete the photos and I refused. I stood at the bottom of the stairs with my hand out waiting for her to put my phone in my hand and then her mother sort of got it off her after a struggle between the two of them.&#60;/p&#62;
&#60;p&#62;Her mother then said Nick go outside and I said not until I have my phone and then she threatened to call the police at which I gave her a funny look. She then said go outside I&#38;#039;ll give you the phone so i stood half in half out with my foot lodged against the door so they couldn&#38;#039;t slam it in my face. My ex&#38;#039;s mother handed me the phone with my ex trying to grapple the phone off her own mother. She shut the door and I walked off. My parents have never seen the little one in person, nor has my nan or my sister. So photos are the things I have to see him when I don&#38;#039;t get to see him in person and hold him.&#60;/p&#62;
&#60;p&#62;My ex then called the police and distorted the whole story and claimed I assaulted her by &#38;quot;grabbing her by the wrist and dragging her back down the stairs&#38;quot; the only time we may have physically touched is when she snatched my phone off me. It&#38;#039;s rediculous and I would never put my hands on a woman under any circumstance neither have I ever had a brush with the police. I had to give a recorded interview statement the next day on Sunday morning. The accusation was dropped as there was no evidence to say I had done what I was accused of and my account of the incident was far more in depth.&#60;/p&#62;
&#60;p&#62;I now couldn&#38;#039;t have my contact with the little one Saturday just gone because they will not facilitate contact in their home. I get absolutely no protection and am sick of being accused of things that I haven&#38;#039;t done. I am really worried as to how far she is willing to go. As if its not enough to sever my contact with the little one she actually tried to incriminate me, producing a fabricated story and lieing to the authorities. I will be taking her to court again to get the order enforced as she has breached the order in 2 out of 3 contact sessions. It&#38;#039;s a horrible situation but Chuck [my little boy] has a right to know me and now I will have to wait for a contact centre to host the contact and that could be a month away. 4 hours with him that I will have been made to miss and any bond that started will have gone so I&#38;#039;ll be back to square one yet again.&#60;/p&#62;

<description>&#60;p&#62;Check the paperwork from tax credits and see if you are the lead name (you probably will be).  My husband was when we married, although the claim is for my daughter.&#60;/p&#62;
&#60;p&#62;Ask your wife to call them and say she wants the child tax claim putting into her name as the child is her child and not yours.  I told them this and they did change it to my name.&#60;/p&#62;
&#60;p&#62;Apparently taking money in this way is is currently being looked into as it is morally wrong to force one family into poverty to support another family who already probably get their own tax credits.

The PWC can &#38;#039;opt out&#38;#039; of applying for child support, they do not have to give a reason but if you cannot show &#38;#039;good cause&#38;#039; for opting out , this can lead to a reduction in benefit. Note: REDUCTION not CANCELLATION.&#60;br /&#62;
&#38;#039;Good Cause&#38;#039; are things like  - applying for Child Maintenance will put the child at risk of harm or undue stress.See CSL 100 for more about  Good Cause.

<description>&#60;p&#62;hi all i am on benefits and on friday i was called into my local job centre and i was told if i did not give my childrens fathers information then i would lose my benefits, why do i have to do this, my ex partner is a good man and doesnt give me money directly but does pay £200 each month to each childs bank account, without fail its there on the 15th of each month, this is so they can have a good start when they leave home (accessable when they reach 18) &#60;/p&#62;
&#60;p&#62;how can they threaten my benefits? this really worried me so i gave his information, now he says if he ends up paying to the csa he will stop putting the money into their accounts, this is just messing with my childrens lives, why are they doing this?

<description>&#60;p&#62;Maintenance is due if the child is under 19 and in full time,  non advanced, education. (not higher than A level standard).&#60;br /&#62;
Both the NRP and PWC are legally advised to notify the CSA of a change in circumstances, which obviously includes the child no longer qualifying.&#60;br /&#62;
Don&#38;#039;t bother with the phone. Write to the CSA and try some bullshit. Tell them you have been advised the child no longer qualifies. The CSA will have to contact the PWC and she will have to make a statement to confirm the child still qualifies. If true, she has nothing to worry about but she&#38;#039;d have to be desparate to make a false statement to the CSA.

<description>&#60;p&#62;That&#38;#039;s a strange and incorrect piece of advice you&#38;#039;ve been given.  Get back in touch with the CSA and ask them to investigate.  For the most part they only need to a child benefit check.&#60;/p&#62;
&#60;p&#62;If they refuse to do that, put in a complaint.  Also make a note of the date you made the original call.

&#60;p&#62;Don&#38;#039;t accept this from the CSA. Write to them, ask them to provide the Clause in Primary Legislation where this Rule is located. If they don&#38;#039;t provide it or flannel you, it probably does not exist and they were just trying it on with you.&#60;br /&#62;
If they don&#38;#039;t provide a satisfactory answer, write back, make sure it is a letter of Complaint and after a couple of months, lodge a Complaint with the Independent case Examiner in Chester.The ICE should get the CSA to provode the answer.

There is also &#38;quot;shared care&#38;quot; to consider (p69) where an NRP provides overnight care for at least 52 nights per year. there is a table&#60;br /&#62;
52 to 103 nights reduces the maintenance by 14.3%&#60;br /&#62;
104 to 155 nights reduces the maintenance by 28.6% etc.&#60;br /&#62;
The moral argument of the PWC not being bothered to work is ignored. CSA view is &#38;quot;tough!&#38;quot;&#60;br /&#62;
Write to the CSA, ask them to review your case as it sounds like you are paying too much.

<description>&#60;p&#62;Sorry got that the wrong way round it&#38;#039;s 40% to CSA, 60% to my partner but that&#38;#039;s only £500 a month. His ex won&#38;#039;t tell CSA that we take the children overnight as she would lose some money, we have considered trying to move closer to them so we could share custody but because of rent arrears we are stuck here. We have been to CAB and that didn&#38;#039;t help much. Visiting our MP is a great idea, we didn&#38;#039;t think of going that far. The worst thing is the strain its putting on our relationship. I knew it wouldn&#38;#039;t be easy but I didn&#38;#039;t think it would be this difficult. Thanks for the reply

&#60;p&#62;It is an awful scenario and you don&#38;#039;t get any other help at all.  CSA take maintenance the same as a deduction of tax and national insurance and do not care about your other credit commitments including house expenses.  They would rather see people out on the street or bankrupt than being fair!  Their advice to me was contact Citizens Advice for help with debt problems - told them it was the CSA and maintenance that had caused the problem, rest of the debts were manageable!&#60;/p&#62;
&#60;p&#62;Has your partner went to his MP for help?  That&#38;#039;s the road we have had to take and now the CSA are taking 30% of his salary and we are still arguing as none of their assessments and details of arrears are correct.  They are a total nightmare

<description>&#60;p&#62;Just now I think the complaint is only with Parliamentary Correspondence Officer within the CSA and has not escalated further.  We have asked them to provide evidence  that my partner knoow of the debt which they won&#38;#039;t do and said we have to go to Data Protection Unit to get copy of file which we have requested but it takes up to 40 working days to get that.  I am going back to MP tomorrow to get further information.  In all honesty the MP&#38;#039;s office are not sure on a few things either but don&#38;#039;t seem to be checking it all out fully.

<description>&#60;p&#62;I should probably post that the children are 10, 11, 12 and 13. Their mother has also never had a job and is perfectly happy not to work, to provide for her own children. My partners parents also contribute a lot, they pay for all clothes and extra curricular activities. We also take the children to his parents for 3 weeks a year.
