Ex refused DNA test but CSA still deducting money from me

I divorced my ex wife back in 2006. we had a little boy together. on december 25th 2006 my ex kindly informed me that she was having a sexual relationship with her boss at the time our son was conceived and that he might not be mine. Although she was perfectly happy for me to put my name on the birth certificate as the father knowing this.

Having heard nothing from her for 3 years i received a letter from the csa saying they need my details. I contacted them and informed them of the paternity dispute to which they said they would organise a dna test. This was in 2009. Having had no response from them and chased them up i was told my ex wife refused to go through with the dna test. This is the last i heard from them.

Since then i have heard absolutely nothing from them. my address has been the same as have all my contact details. I joined the raf in 2010 and have been with them ever since. I received a letter on the 18th of july stating that a total of £383 will be deducted from my earnings from august. is this fair after hearing nothing from them in over 3 years??

I dont think so. i dont earn enough as it is and to lose that much will put me in serious financial hardship bearing in mind i have joint custordy of my second son. i have sent them a breakdown of my income and expenditure but cant see any way of keeping my head above water.

To make things worse im being deployed to afghanistan soon and the way things are going this issue wont be resolved before i go. what the hell am i supposed to do??? Somebody please help!!!

    You need to get a paternity test done , As your on the birth certificate & was married its assumed by the CSA you are liable, i.e. the person that is going to pay, you can ask for a Subject access report to find out if you were informed and they have followed procedure , if you are still in contact with the child concerned do a private DNA test with the kid to see the likely hood of you being the father , if the test shows you as the unlikely father inform the CSA of this and ask that the case is reviewed , you will have to push the matter , only deal with CSA in writing , there are time limits on when you can appeal a decision, most of the the information you need is available on direct.gov , if you defend yourself in court you have whats called the right to an audience , do some research, Independent case review, DWP complaints , 1st tier review, DNA testing kits, Also inform them your on active duty it may not be possible for you to reply within time limits , they are really slack they send out enforcement notices and such that give you 7 days notice second class so you get them on the sixth day , Its a shame Parliament have given them a mandate to act there powers are being extended so they can circum-naviagte the courts, I’m sure It won’t be long before someone puts in a claim of Mis-conduct in public office to the police re the CSA , they are for want of a better word Total C@@ts
