CSA wants my new partner’s money as well as mine

I went bankrupt 3 years ago and ended up with nothing but a dept to csa of about 7,000 pound.

I have two kids with an ex, my boy came to live with me for three years,which they still charged me for my daughter that lived with my ex. When i put a counter claim in they kept fobbing me off saying it was being dealt with. Eventualy they said there is no record of the claim, the person from csa i spoke to said it was probably lost when they changed over the computer systems so since then it has been to court.

Bailiffs have been round, but got nothing as i dont have anything. I dont earn much money as i am self employed and when i dont have any work they still charge me and send theatning letters. They want money from tax credits which my partner gets and wont let me have as she says she got that and more before i moved in, so i cant have any to give to csa and they use her child tax credits wich are nothing to do with me as part of my wage.

My partner say she was financialy better off before i moved in as she works and gets all the top ups. I just dont know what to do as i am being got at from each angle, cant win, and when i went bankrupt there was £10,000 in the bank which i think should have paid csa first to leave me dept free wich is why you normally go bank rupt, regards paul.

    I have to agree, it is fundamentally amoral to take money meant for one child who onviously need it, the child tax credit, and give it to another child who doesnt.

    People need to pester their MP about this injustice, its the only way it will be changed.

    The CSA rep you spoke to is wrong. Child Tax Credits CANNOT be taken into consideration as part of your income. However, if you have a joint claim and have been awarded Working Tax Credit this will be taken into account, but definatley not the child tax credit element. I share your frustration I am the new parent of an “absent parent” and he has arrears due to the CSA’s inability to calculate things correctly, what astonishes me after speaking with the CS just this week is how they speak to you. They wanted 40% of my partners wage of £260 per week, which they say was £107 per week leaving us with £150, this is to support 2 adults and a teenager who is mie, we get no benefits and have to pay a mortgage and council tax etc. The Parent with care and her new partner do not work and they get £478 per week in benefits due to his apparant disability and her apparant need to care for him (but thats another story), they do not have to pay rent or council tax. So they will have her living on over £500 per week as from April parents with care on benefits now keep all maintainance payments without it affecting their benefits. And us who do go out and work are left with £150 per week to pay for everything – Where’s the justice in that! According to the CSA they dont care about what we are left with – all they care about is the poverty of the children who live with the parent with care – but my son is to suffer and live in poverty due to this – there is something wrong in the system if you ask me!!!!!
