CSA starting taking larger payments earlier than they informed us

My husband has been contacted by the CSA regarding payments. His daughter is now 19 so he no longer has to pay maintenance. There is arrears due to when his work was low, and owes around £1500. They wrote to him and said they will deduct £66 per week from his salary, which he informed them this would be too much as we have 2 young children at home, which he as informed them on so many occasions. They said they would look into this and re-calculate.

We have heard noting more from them, but they have now started deducting £75 per week. He contacted them to which they replied that this should nor have started until 19th June 2017. He has since spoken to his employer who say its nothing to do with them, and the CSA keep saying the same thing, and never calling him back to resolve the issue. We are willing to pay the funds back but £75 per week is far too much that we can not pay all of our bills and put food in our children’s bellies. I just need help to see what we can do.

    The CMS always look at your top line never what your outgoings are. You just need to keep ringing until you get an answer. Not ideal but with them it never is.

    CSA only can take 15% from you monthly income before TAX (12% Child Maintenance Service) If you on the low income you only paid 15% what ever you are income is that month but you need to inform them. You need to ask them for the statement. It will show what date and how much they will taking from you. If you daughter us 19 and still in full time education you maybe still need to pay for them until 21 I think. But if she is working than you can stop. The arrears doesn’t count if you on the low income. The laws said by CSA you need to pay 15% nothing more, give them a copy of P60 and calculate how much you already paid.

    CSA have to deduct the payment if you had 2 young children living with you permanently. So you should be paying less. Always keep phoning them up don’t leave it for more than 3 days.

    You are legal rights is to only paid 15% less if you had children living with you. If you on benefit you only need to pay £5 a week and they can’t back dated if you are unemployed. But is you are job to inform them with any changes.

    pay what you can afford on the agreed dates,
    if you do this, you can stand in front of the appeal judge demonstrating they you are trying to make it work, don’t be afraid of them and remember , this will go on for a very long time, my son and daughter are 31 and 26, I’ve paid over 60K and they still think I should pay my dreadful ex wife 10 k as a lump sum, so play the long game,
