		<description>Thanks for your response Chall. The only info they had was calling an old agency he worked at for a month. In that month he earnt about £400. They put that £400 down as a weekly wage for 51 weeks. In the whole year he netted £5393 in earnings and they want him to pay £2398 in maintenence!

Also, I thought child tax credits were for the benefit of my children and I&#039;m very shocked to discover they can be used in this way.

I went to CAB today and they have said first and foremost to appeal against the decision in writing because if I don&#039;t the court won&#039;t allow me to on the day so that is my next step.

Oh, and to make matters worse (or maybe just for her...) his ex told the CSA she hasn&#039;t seen him since she told him she was pregnant and that he&#039;s never seen his child! I did point out we have photos of him at ours last year so the stupid bitch just dug herself a little hole which I am happy to make deeper.....</description>

If the agency had all the relevant info need to make the liability calculation in 08/09 and they have made a mistake in the said calculation, then the official error can be corrected at any time.
However, they will not carry out a retrospective reassessment.

Child tax credits are fully used as the NRP&#039;s income. 
If you claim working tax credits, these are deemed the income of the higher earner OR if earnings are equal, split 50/50 for the purpose CS calculations.

		<description>Sorry, just to add insult to injury, I&#039;ve just spoken to the CSA again who admitted their calculation is wrong in year 08/09 but because they will not back date it that far (we should have been paying £5 but were paying £46 per week!) then we&#039;ve got to pay the £2500 asked for that year so tough! I&#039;ve also discovered they went through MY tax credit records to make sure I was telling them the same income story and are now using my child tax credit as income for my husband!!! WTF! I have an interview with my local MP next Saturday, fingers crossed she can help but all advice would be hugely appreciated :o)</description>
