They even threatened to take my house.

I have been to court so many times i have lost count. The csa say it is always best for you to attend, what a load of crap. You sit there the csa rep says what she needs to say, the judge asks if you have anything to say, you say what you want to say, then the judge makes the award to the csa after telling you that he basically isnt interested in what you have to say. So after all that you have taken a day off work without pay to attend the court and try and come to a reasonable solution, only to be kicked in the man vegatables and made even worse off than you were before you attended court.Well that was worth it !!!!!!! not.

The csa had all my details so they could see how much i was supposed to be paying. I like most people under the scrutiny of the csa i had crewed up arrears. The csa came back to me some time later and said you have been assessed that you can only afford to pay x amount a month on your earnings after your personal allowances have been deducted. Six weeks later I get a letter saying you have now got to pay x + x per month.

This totally stressed me out so i made the phone call and explained that i had had this letter and couldnt afford the extra payment per month only to be told you will pay this or we will go to court for a liability order. I replied by saying you have assessed me and told me that I can only afford to pay x per month, you have set this amount, and now your saying you want extra. I said I simply cannot afford the extra, only to be told , you will have to pay it or we will go to court and get a liability order. Do you ever get that feeling that you are going round in bloody cirles. The csa just havent got a clue on how to use some common sense.

When you go to court the feeling I get is that the judge sees what he is dealing with and thinks oh dear this really is a government issue i best not decide against that. I have been divorced now for over ten years, I havent seen my twin boys due to the fact my ex mrs stopped me even though I had a court order granting me access. The csa should have the power to say to any family that has gone through any kind of break up that If eithern party donot adhere to any court order assistance from the csa will stop. But anyone who has dealt with the csa will know they dont have one bit of common sense. Well I have had my rant, and got myself wound up again. I am now one of the lucky ones because my case is closed in march this year. Just one more thing, I have an idea has to how the government can save millions of pounds per year. Why the hell are we paying child support to families that have got children over the age of 18. This is where the government have no idea what so ever.

18 is the age of majority, so you can consume alcohol, smoke, watch porno movies, join the army shoot and kill, and vote as to which political party you want to run the country. So when I child reaches the age of 18 stop the bloody family allowance and give the bloody tax payer a break, at 18 you are an adult not a bloody child.

This is new to me but I thought I would share this alarming advice I received from my case worker in Nottingham.

I wrote a post a few days ago “Lost my job because of CSA“.

Now I have asked NACSA to represent me as the CSA where twisting words, making things up as they went etc. Well now my case worker is “Geraldine Newman” CSA Nottingham is trying to force me to claim benefits. Because if i don’t the CSA will not be able to confirm my earnngs and want to know “how I will live daya to day”!! she has given me 7 days to decide! I’m speechless..now my question is:

1. Do I have to try claim benefits?

2. If I don’t or cannot then what? I’m out of work because of what the CSA done to me.

3. Unemployment office tell me I cannot. And I do not want to degrade myself any further.

4. Do I just leave my keys at the door and leave the country or lay down and die!.

NOW please pause and think about what must be going through my mind at this point. WHAT DO I DO!!

I am writing to register a formal complaint against the behaviour / actions of the CSA. In Dec 2010, I noticed my wage was short of £300+, I checked my wage slip & saw that there was an adjustment on it. Phoned the company’s HR department and that is when I first found out that the CSA was involved. There had been no prior warning by letter before this initial contact. I then contacted the CSA who then informed me that I had been named as the father of a child who was now 8 years old.

As you can imagine this was a bolt out of the blue which was a great shock as! Was 100% certain that I had not fathered her child as I had not slept with the mother? Despite my insistence on not being involved, I found that I was spoken to with great disrespect and actually was made to feel like a criminal. At no time was there any help or advice given to me as to how I could resolve the situation or prevent the payments from being taken from my salary. I was presumed guilty without even having being asked any questions. On several occasions I contacted The CSA only to be met with the same obstructive unhelpful attitude that I was committing some great sin by denying my involvement Throughout this whole mess, The CSA have failed on all aspects of their DWP customer charter.

1. Right treatment – obviously this is a mis administration which needs immediate correction and the poor treatment I have received by CSA representatives

2. Right result – as the DNA result proves

3. On time – Too long has been taken to look into the situation as no-one has actually taken time to hear my side of the story

4. Easy access – on all occasions I have had difficulty getting answers from the CSA. On numerous occasions I was told the case worker on my case was on holiday that day and nobody else could deal with it.

I am now happily married and am fortunate to have an understanding and supportive wife who is expecting our first child in June. This kind of stress and untrue allegation could ruin a lesser stable relationship and i am very angry at the unnecessary distress that this situation is causing my wife. We should be enjoying her pregnancy however we have this financial worry looming over us. I lost my job due to redundancy in October and am under a lot of stress already without this situation which is of no making of mine As you can imagine, I was keen to prove that this had been a case of mistaken identity and agreed to have a DNA test. As I fully expected it to, the DNA test proved that I was not the father.

Now, after 9 months, I have been contacted again telling me that another investigation has to take place, during which time I am expected to make payments again as the mother has disputed my identity by saying that the photo she was shown of Justin Wilson was not me. How can this be disputed, surely the CSA appointed GP will have had to take copies of my identification at the time of taking the test. Are you now questioning the integrity of the GP? I am sure that they will be very offended if this was the case Does the fact that the mother does not recognise me from the photo AND DNA proof not convince the CSA that I am not the father? What else can I do to prove this and get back payments that, in my opinion, were illegally taken from me In summary

1. I have made all payments and fully co-operated in all CSA requests however unreasonable they have been

2. My wife and I have suffered great stress and financial hardship owing to this situation

3. I underwent a DNA test at a GP approved by the CSA which has proven that I am not the father

4. I feel that this situation warrants an immediate review

Should I have not received a response from yourselves within a reasonable timeframe, I will take further action to resolve this by contacting the Independent Case Examiner for further assistance

I have put in a complaint as I believe this is fundamentally wrong. The complaints wworker who called me last week agreed that they should not be withholding my regular maintenance as it is supposed to be paid to me regularly and has nothing to do with the arrears that have occurred through no fault of mine or in fact my ex husband, he also said that until the case worker had missed the deadline there was nothing the complaints department could do to hurry the work along.

The deadline for this work being complete was originally 27/01/2012 but last week I was informed when I called to check on the progress of this work that it had been passed to another “service excellence team”, (A term I find hilarious as there is no service excellence from the CSA whatsoever), for them to do more work on this and because of this the deadline had changed and it could be another 12 weeks before it might be completed. I told them this was unacceptable and no way would I be waiting that long for it. This would take it to 6 months with no regular maintenance and still no arrears. I have since had a call from the CSA from the complaints department to say they are now taking over the work as a manager had registered a complaint as the case is going around in circles.

I was told I would have a phone call within 2 working days from the complaints worker who was allocated the case. It is now 3 days and the call has not come as yet, at time of writing this they close for today in 45 minutes so I won’t hold my breath that it will come today, even though I was assured when I called up this morning that I would be contacted by the end of today.

At no time was I contacted to tell me about the fact that my money was going to be withheld or to inform me of these arrears owing to me, the only reason I found out about the arrears was due to receiving a new payment schedule and the arrears were detailed on there. It was not clearly detailed where the arrears had come from and it took 4 or 5 phone calls to verify they were owed to me by the CSA and not my ex husband.

I had to put in a complaint in Feb 2011 as yet again they withheld money for a couple of months while they did an account breakdown. My complaint was upheld and I was told that if in the future any work was to be done on my case I would still receive my mormal regular maintenance, this happened for a few months and then I was back to square one again with me having to call every month to ask them to release my maintenance. Told on several occasions that yes it had been released only to find out it had not and the call handler who informed me it had been released would’ve seen on their computer system that was not the case therefore they were lying to me. Nobody at the CSA seems to want to be held accountable for the constant errors and mishandling of my case and quite frankly i’m sick of it.

I have wrote to the Secretary of State myself and also have an appointment with my MP tomorrow morning to see if I can get this matter sorted as it is causing me alot of stress, upset and sleepless nights trying to resolve this matter and it feels like i’m banging my head against a brick wall.

prior to the CSA getting involved I paid £550 per month for 4 years (plus paid for lots of other things), never missed a payment or paid even a day late. I saw my child Fri-Mon every weekend in term time (despite life being made as awkward as possible by his mother)and a big chunk of school holidays, a very close relationship and in excess of 104 overnight stays. My son’s mother then left the country without my consent and without giving me a forwarding address. I discussed this with the Ministry of Justice International Child Abduction Unit who told me stop by payments. A week after I was due my next payment I was in the High Court trying to find out where my son lived so i could find out if he was safe and to see him. My barrister said resume payments, i did, but 15 minutes later the CSA called and it was downhill from there.

My child’s mother called the CSA that morning, they called me within a couple of hours, my employer received a letter 24 hours later and was forced to reply within 48 hours. The following week I was told I had to pay £645 based on zero overnight stays because they knew I didn’t know my child’s whereabouts, therefore how could I have overnight stays? It was put to me ruthlessly without any tact or concern. They were not in the slightest bit concerned or willing to discuss that a criminal offence could have been committed. They just dealt with the facts: I don’t know where my son lives – therefore I can’t possibly have overnight stays.

4 months later, having spent £12k on legal costs to get contact with my son while he is abroad, I still pay £645. Last month I was buying food and petrol on a credit card for 2 weeks before I got paid. it will be similar this month. I went to the south of France to see my son, stayed in a hotel for 2 nights – zero overnight stays, hotels don’t count. I had 14 wonderful overnight stays at my house over xmas. I have to collect my son in February for a further 14 overnight stays and have paid about £500 in flights to collect him. I have a High Court order setting out contact, 14 night stays at each French school holiday and half the summer holiday. I still have zero overnight stays, the contact is ‘irregular.’ I’ve filled in the CSA variation form with details of over £1000 in travel expenses – I still pay £645.

I have explained that my previous years earnings are skewed by extra out of the ordinary earnings I will not get again, so the £645 is a big proportion of my regular earnings. Not interested.

When contacting the CSA I have spoken to some of the rudest, unpleasant and incompetant individuals I have ever dealt with in any situation. I literally begged to find out what is the definition of being under their jurisdiction, one person told me to ‘go to a library and look it up yourself.’ Finally, I dealt with a manager who was helpful plus a man recently and they spoke to me like I wasn’t criminal. Still, nothing has been done. The others have been simply appalling, an embarrassment for any decent human being working for the CSA and the politicians who created an organisation that was supposed to help to destroy lives.

What I don’t understand is how unbelievably ruthless, powerful, uncaring, swift and unjust they have been, yet I hear other stories. To rub salt in my wounds my girlfriend contacted them about her ex who has paid less in 6 years than I paid in December 2011 alone has been told they will take about a month to look into it and there is probably not much they can do about him fiddling his accounts to lower his earnings, offset tools, petrol, food etc. It’s very odd and extremely inconsistent.

I would like to know why the CSA has a culture of rudeness and mindless ignorance. Most are very poorly informed but sure they’re right. I mentioned my High Court order served by one of the most senior and high profile Family Law judges in the UK at the Royal Courts of Justice, dealt with a lot of famous cases, the thick CSA person proceeded to say that the High Court has no power over the CSA, it is above all other Government departments! I had to laugh.

Sorry for the long-winded story. I’m off to Liddl now to do my shopping.

An Angry CSA Victim

I have been making payments to my ex-wife (that were calculated by the CSA) for my children for the last 4 and a half years. For some reason, unknown to me, she recently approached the CSA and asked that they now collect payments and to re-assess the payment amount.

The CSA phoned me in December and insisted that I give them my bank details. Of course, I refused. I asked them to first send me the information in writing. I received two letters in January: one letter was a demand for payment, the other letter informed me that they would now be collecting the payments. They told me to provide the information, and the payment, or they would be seeking court action.

I replied to them asking for the legislation that they were acting under, a Subject Access Request, the logic that was used to calculate the arrears and verification of who they were. I told them I would like this information before I give my bank details – If any other organisation requested my bank details and a issued a payment demand, that organisation could not have acted in the same manner as the CSA. It is my assertion that the CSA acted outside the scope of the Child Support Act and, therefore, acted illegally.

The information I asked them for was merely a verification, prior to sending my personal information to them.

1 week after sending this verification request, I received a letter from them informing me that a Deduction of Earnings Order had been issued. They had completely ignored my request for verification. Immediately, I called them to ask why the DEO was issued and they said, they are usually sent out to parents who are “non-compliant”. They are not able to demonstrate that my request was non-compliance.

I believe their actions were illegal for various reasons. They have breached the Protection from Harrassment Act 1997, Human Rights Act 1998, the Child Support Act 1991, European Convention on Human Rights and the Universal Declaration of Human Rights.

I do not believe the CSA should be allowed to continue this dictatorial behaviour with impunity. I aim to take this as far as I can to get an apology and to reduce the risk of another individual suffering the same alarm and distress that I am suffering.

His eldest child is now 17, and his youngest is now 10. He POPS up to my home like a bad penny every so many months, but has never gave me anything for their upkeep since they were born. He rarely sees them and all he has done is cause me trouble with my New Partner.

I am fuming that he hasnt been dealt with and it seems to me that i have always had to contact the CSA myself. This horrible Man, if you can call him a Man, has done nothing but humiliate me past and future with all this crap.

I even gave the csa details of where he worked who he works for and he doesnt pay any Rent, COUNCIL TAX as he lives with his Nephew and his two children.

I have done everything to get him caught by csa, but nothing AGAIN!!!! He actually made a comment to my two Sons and said “If Ididnt have you two today,I would be at work now making loadsa money now, do you know that?…my blood is boiling i hate him, and i hate the CSA for not doing anything for me and my children

He also knows that my Partner Paul went to work TO SUPPORT HIS THREE CHILDREN AND STILL NOTHING HAS BEEN DONE TO HIM. He has a Bank account anULTIMATE REWARD BANK ACCOUNT AND HAS A LOT MORE MONEY THAN ME. I have tried to get Employment myself but i had no problems getting the Jobs, it was when it was all calculated up, wasnt worth my while. I was WORSE OFF, so even that gets to me, knowing that i tried but i had to stay home with HIS THREE CHILDREN WHILE HE REAPED HIS OWN HARVEST IN, AND WHAT A GOLDMINE HES SAT ON NOW.

He only ever turns up to cause bother….

I have attempted to call them several times and I am just meet with rudeness and stupidity and false information. One person says one thing another person says something else. We really need help in getting this situation resolved, we are happy to pay as long as it is fair and they are reasonable.

They are now taking us to court and claim we owe thousands despite the fact we have over paid far more but they claim it is not their legal obligation to repay the money. If we owe them we have court letter and suspended passports and bank accounts they owe us and its just ok!!

Haven’t you thought who is stuck in the middle? The children! They are the ones who are suffering, they can’t go out with there friends because YOU have not paid.Have you wondered why your child doesn’t respect you? Because you have left there mother or father in debt because you do not want to pay.

I wouldn’t be surprised if they did not respect you for the way you have treated there parent.

I am in that situation I am a child and I don’t respect my dad after the way he has treated my mum over the years.

I know what It Is like! And It Is not fair having your dad moan on at you about the CSA blaming ME for his debt.

Do not let your Child get in to the situation I am in because soon enough they will want nothing to do with you like I want nothing to do with my dad.

So like a fool i was paying her £260 every month she then thought that was not enough so approached the CSA i still ended up paying £260 so no problem until i lost my job thru no fault of my own and i set up my own business i have had the csa constantly on my case as my money was tight and she did not need it so you pay who you have to or so i thought! so 3 yrs down the line i have been to court fined £450 had a charge put on my house and i have now 7 days to stop a forced sale so that they can get £4700 out of me.

The system is so wrong i see my children every week and stay over 2 nights every week and if they did need the money i would have sold my house, would of found it somehow but they dont. Its pointless speaking to the CSA they see us all as bastards not interested in what the mothers got or does she need it???? for fcuk sake my x wife and the csa have had no communication for nearly 3 years, how desperate is she? yet they keep on and on at me.

I paid them £1900 3 weeks ago the very professional company put it in her bank, no letter no phone call no nothing what are they all on there? To sum up it does not matter if the children need the money it does not matter who the mother lives and how much he has got what the csa see is you should pay and if dont we will take your house off you so you’ll have to rent a flat all for your children who want for nothing! how nice? hey but if i moved in with a rich girl they take her salary into consideration and i’d be paying more!
